That is one of the definitions of a contract to exchange $ for goods. When the supplier excepted his money in the exchange then that sale is a legal contract. A contract doesn't even have to be written... it can be verbal, just a little harder to prove but is still a contract. Unless there was a disclaimer on the website about pricing and error then legally the supplier has to provide the rack at the agreed price.

Now it would probably be more of a headache to follow through legally then whats the racks worths but thats a different story.

 

He has no legal recourse to force the company to sell the product at that price. They can cancel the sale and refund the money at any time

 

Yeah, I'm just waiting to hear from them on what they want to do. I'm not here to screw over a business. I just want he rack for what was listed if not then I will go elsewhere and pay more. This isn't a witch hunt of any kind and that is why I haven't said the company's name.

Legally can't back out of a sale unless both parties agree. Yes the supplier will most likely cancel the sale and hope @Reklov doesn't fill charges bc the time and $ isn't worth it.

So if you go out and buy a $400,000 house and the seller mislabel it at $300,000 (25%) then they take your money. Two weeks later they come back and say sorry the house is worth 400k and was missed label so we are going to cancel the sale unless you pay $350,000. You think the previous home owner has that right to just cancel the sale?

 

The buyer of my last house dropped out of the deal the day before closing. So yes.

That being said, real estate has its own set of rules and laws so it not a comparable example.

On top of that, when you buy a house you actually sign a paper contract.

Thirdly, in a real estate sale money is not exchanged until the title is signed on closing day. You don't pay 2 weeks before I give you the deed.

 

A better example would be you pay me to mow your lawn this Friday. On Thursday I decide I can not do it and cancel the deal. I refund your money. You can not legally do anything to me if I return your money

 

Unless it's bait advertising, which Im not sure this is an example of, then there's no law that requires companies to honor an advertised price if that price is wrong.

 

Its the same principle... a contract can be verbal. I didn't say you pay 2 weeks in advance... I said you paid already and they accepted your money and they come back and say no deal. Once money has been exchange the supplier agreed on the deal... that is their acceptance of the deal.

It doesnt change anything. If you paid and the seller accepted the money they are not legally obligated to now follow through with the sale. They can cancel your "verbal contract" at any time and return your money. There is nothing you can do about it.
