Brake malfunction and CEL

    I would keep calling them and asking for the status of the vehicle. For my state, 30 business days of mechanical maintenance or 3 separate incidents with same problem will qualify for lemon law. I would def check for your state since your at 12 days without your truck. Once you checked the lemon law criteria for your state, I would bring it up to the sales manager and let him know you read the lemon law and soon will qualify for arbitration. Like others mentioned they dont want to go that route if they dont have to.

    just curious, did anyone who had this break over ride malfunction have it happen after using the Bluetooth OBD connection for the torque app? cuz that's when mine did and I was concerned that maybe it caused it.

    Did you have a sudden loss of power when you pulled out onto the intersection? Like you pressed the gas pedal down but the truck would only creep forward?

    yes, I got the message while waiting to turn left onto a two lane highway. when I went to turn left there was cars coming from both directions. I had enough time to turn but when I hit the gas I just coasted into the middle of the street

    You might check the lemon law verbiage for your state. I went through it in CA and it was a really structured timeline that Toyota had to respond. This may not be "lemon law" applicable because typically you have to give Toyota a "reasonable" amount of attempts to repair the vehicle; however, there is precedence of another customer getting a vehicle replacement due to a similar issue. I would hook up with that guy in HI and build you case, then demand nothing but a vehicle replacement. Keep good records and try to get all your communication in writing.

    Sounds like a serious safety issue. Get the NTSB involved.

    Toyota has had at least one safety recall on the '16 already, I'm sure they are eager to keep this out of the press.

    California has very pro-consumer Lemon Laws. States like AZ do not favor the consumer nearly as much as CA's rules.

    That's interesting. I got an ABS malfunction warning when I had a bluetooth connection to Torque. This was after having no issues with it one time previously. I pulled out the unit, no change. Then pulled into a parking lot, turned off and restarted truck. Error was gone. Make me not wan to use an OBD bluetooth connection again.

    Seriously, you spent big $$$ on a new truck, you won't use Bluetooth because you fear triggering another ABS malfunction?
    Electrical gremlins can be tough to fix, maybe you can get another truck.

    Using a 3rd party App via an OBD2 Bluetooth connection is somewhat different than just using Bluetooth to connect to the Entune system. No way from what has been posted so far to tell if the problem is with the truck or the app...or neither.

    well I used the Bluetooth torque connection for four years with my Ford, and it was a lifesaver but then again it was always breaking, the truck that is, but that wasn't because of the Bluetooth, it worked fine. I want to use it cause its awesome, and I feel like a $34,000 truck should be able to but I don't really want to risk having this malfunction again. Pain in arse. Guess I could see if it happens again and try to trade up one more time? Take that Toyota

    I bought a 2016 TRD Sport at the end of last year. in the first thirty days I started getting the error “brake override
    malfunction, see the dealer”.

    At first, they thought that the brake sensor was adjusted too tight so they backed the sensitivity off. They insisted that I had jumped the battery, or that the battery had been jumped after I took possession of it. Like I would hide that fact on a new truck.

    Then the hill assist didn't seem to be working. before I had brought it in, I thought for sure that when the brake was depressed for a few seconds it beeped to tell me that it was engaged. After the first repair was done that beep went away. They had the truck for a week and couldn't find anything wrong.

    A week later the error came back, this time the brake switch was replaced.

    A few days later I got the error again. When I picked it up the fourth time I was told that when the truck was made the person that installed the wiring harness had
    forced a broken connector into its receptor. Since that wire was broken it was intermittently causing this error to occur. They replaced the entire wiring harness. That seems to have fixed the issue. I have not had the issue since May.

    I pushed with corporate to have the truck bought back or replaced because I felt unsafe driving the truck after all of that but they would not and legally did not have to replace the truck under CA lemon law. Lemon law was at the very edge. I calculated that the truck was in the shop for 26 of the first 119 days that I owned it.

    CA Lemon law
    • 2 attempts or more have been made by the manufacturer to repair a warranty problem that could result in death or serious injury.
    • The manufacturer has attempted to repair the same warranty problem at least 4 times.
    • The car has been out of service for 30 days or more for repair to warranty problems.
    • Problems to the vehicle are not the result of abuse by the owner.

    They gave me an extended platinum warranty and sent me on my way.

    Hope that this helps and that they take care of you. It's a great truck now that it works!

    No new issues. I have 15k on mine now. Got some cash and platinum 8yr125k 0$ Dede table warranty. Thinking about selling it not sure what it would bring.
