Is a "New" Toyota truck with 289 mile on its odometer - really considered new?

My "new" 09 DC TRD had 7900 miles when I bought it. The sales manager used it to commute about 45 each way for several months, and probably hauled a few things based on the scratches in the bed. Sticker was 31,500, I paid 26,000 for it. Titled as new vehicle, only bummer is the warranty still runs out at 60K.
