    Imagine how much damage that would do dropping off on the highway doing 75 mph and it flies up and hits the vehicle behind you, or going through the windshield hitting the driver.

    Don't leave that crap hanging on there. Yeah it looks cool, but you are asking for trouble.

    I 100% agree. I'm pretty sure someone jacked it off my truck, but the shackle is more than capable of doing serious damage if it came off while driving. Another good reason to keep it off the truck until needed.

    The Marlin spike probably would do the trick as far as keeping the pin tight, but the risk of possibly hurting someone or damaging property by a runaway shackle is enough for me to keep it in the cab until I need to use it.

    i know a guy who had one of these on his dually. kept it in all the time, until:

    a lady had parked behind him in town and rammed it into her grill of her car.
    she filed a report.
    she sued him in court and,

    you guessed it, she won!

    that's a wtf moment in time.
    this just shows how messed up our society is getting.
    when someone can hit a parked truck and sue for damages against the owner of the parked truck who was legally parked.
    now for the kicker, his insurance wouldn't cover the damages even after the verdict from the court.

    I bet the damage to her car was pretty serious and not limited to the grille. No lawyer would take a case unless damages were significant. Or it was a small claims thing.

    I always wonder about things like this. There is a thread about off road bumpers and accidents. A good fab bumper can dampen the effects of a bad accident, however isn't there some liability when modding your vehicle?
    If you wail into someone with a fab bumper and cause more damage or injury than if you had not had it, there is an open opportunity to get sued.

    So right or wrong, people have to watch out for those things.

    Any chance that there is a law in the state where you can't have anything in the hitch when not using it?

    That hook does defeat the purpose of having a bumper.

    I would imagine that the state where this happened has a law that specifically prohibits leaving in the hitch when not using the vehicle for towing. Even so, this situation seems odd to me. Even when an insured breaks the law (driving drunk, running red lights, failing to stop at a stop sign, leaving a tow hitch in when not towing, etc.), the insurance company is usually still on the hook for the damages arising out of the negligent actions of the insured. Unless the policy expressly excluded coverage for damages caused by the hitch, I don't see how the insurance company could avoid paying the damages awarded at trial.

    honestly i don't know if there is a law or not, or how his insurance reads for exclusions.
    i just know that he was not in the truck and still lost the case.

    it has prompted me to remove my trailer hitches when not in use.:thumbsup:
