Can a buyer MAKE me sell something to them legally?

    in that case, look up the laws in your state, do some research, once you have found it online or whatever that your right, send him a link to the web page and be done with him

    I'm guessing in CA there may be some recourse if it was in writing, even an email. If they are local they would probably be able to drag out the process to the point that you might wish you sold it to them, (court + fees + time) but if they are out of state then I'm guessing there is nothing they can do or would want to do because they would have to be present for court and pay for traveling to and from etc. etc.

    I went through the process of trying to sue someone from out of state and after going to court 1 time I found out I needed to be present 3 more times I simply dropped my case because at the end of the day it wasn't even going to be worth all the time and money I'd have to invest.

    Since you did not receive payment, you are probably OK to back out of the deal... even if the potential buyer gets angry, it's probably OK - but if he has proof you did it to sell for a higher amount, he may be able to sue you for replacement value of the difference (actual replacement cost minus your agreed price), so if he can find it at $5k, you would be out an even larger amount than what you received.

    ... it's still a shitty thing to do as you did agree to terms and gave your word.

    I agree that the pain of different states may make it so difficult that it's probably not worth worrying about... looking in the mirror - is it worth the money to know you're a man of your word?

    Yeah, really worth the time & not a frivilous bullshit tantrum to sue somebody over this at all is it? Bottom line, you signed nothing. Verbal contracts, especially without witness, are nothing but hearsay. So what, something better came along to your benefit. Take the flaming, take the better offer, don't make a habit of this behavior, pay off your debt & sleep well.

    Traveling across the country enough times required to prove they are right is probably not going to be worth their while if they value their time.

    I dealt with someone from Oregon who was only 2 hours away by plane for an item that was valued at $2800 and ended up dropping it because of the cost, but the judge did acknowledge that I did have a legitimate case and thats why I would have to come back for the actual hearing if I wanted to pursue the case. In the end it wasn't worth it to me, if this person decides it worth to them it'd probably cost them the difference in the price to find out if they have a legitimate case.

    You can't ask people to stop attacking you then try to get sympathy for your situation with the IRS - the first buyer doesn't care about that.

    Legally, I would think that you're in the clear.

    Morally...I guess you know what I'm going to say. And for the record, if I was the original buyer and found out that you were selling it to someone else for more, I'd seek legal recourse just to teach you a lesson.

    I think this situation came up in the Charlie Wenzel gears case, you may wanna check it out.

    Hey, I didn't say that's what I would've done nor is it how I roll on everyday basis but sometimes shit happens & sometimes people have to just be over something or be over themselves & move on. We're all "honoring" ourselves into the poorhouse with the way everybody wants a bigger & bigger bite out of your ass everyday in one way or 15 aren't we. The honor system is just as flawed as every other one in this country is about now.

    Here, I'll fix it.............You need to send him back his check AND send whatever he was gonna buy & just forget why it was you wanted to sell it anyway. Don't even try to honor the debt you were trying to pay off in the first place. There, better?

    heres what I would do. Cash the check from buyer # 1, get the money from buyer # 2. keep your item and be done with it. best of both worlds for you anyways. lol only joking. But the right thing to do would be to sell to buyer # 1 since it was already a done deal. You win some you lose some. Its how life goes, we all make mistakes in your case it was a $800 mistake.

    No, the point of the whole original post was if he should honor his word. He wasn't getting screwed by the guy that made a legitimate offer. He accepted the offer, without distress. Verbal contracts are contracts. If both parties are across state lines, it can be a federal issue because of the the interstate commerce clause. Not that this is something that should ever go to court.

    No matter the legality of the issue, it is more about morals. He agreed to a deal and now wants to back out. It is understandable, seeing as hind sight is 20/20 and all. But it is also shafty and unscrupulous.

    OP, you aren't getting screwed on the deal, you just had a better offer come along. Sure, do what ever makes you feel better. If it doesn't cause you to lose sleep, then so be it. I'd sure as shit not do business with you knowing that you'll reneg on a deal.

    I don't break my balls or my word for anyone. It's just how I was raised. Not saying you are a bad person or calling you dirty names, I just wouldn't feel right trusting you in a business matter.

    And also, how not to. Use paypal backed by credit card. As soon as it happens, then the agreement is in writing. Don't send checks with your personal info on them around the country to strangers. Don't send money order & give time for this type thing to happen while seller is waiting to get paid. Paypal is right now, done, over, ship the shit out. And of course, too bad if someone offers 3 times what you just got, it's in the mail headed where it should...to the 1st buyer.
