    Yes they do, and yes it is legal for them to do so, and it doesn't matter if you did nothing wrong, they still can.

    Some departments are now using cars that have cameras on the front and rear of the Police car, they can scan license plates and automatically run them through a database. This system will tell them automatically if the car has a problem, such as no registration, no insurance, an active warrant, or if it's a stolen car, etc, etc.

    Just keep doing what you're doing, which is following the law, and don't worry about it.

    While this was the case, I don't think it's necessarily illegal. Just poor etiquette. After thinking about it a bit, I figured this is probably his system. He probably tags people all day long by driving 3 under the limit in the left lane and waiting for folks to pass.

    Next time travel at night and pull up behind him and flash your head lights at him to get him to pull over....it works for me...thank goodness I was in South Carolina and got an ass chewing.....

    same thing happend to me in pa man expcept i was 16 at the time and the cop told me "you have to be the ballsiest kid i have ever seen to tailgate a marked state trooper" haha lesson learned i think that they just expect everyone to get away from them its like a power trip

    a good rule of thumb is to NOT creep up on the police...and most certainly NOT pass them...

    just sayin ;)

    im not saying your stop was right or wrong...but i do know that when people creep up on me or pass me in the patrol car...most of the time i just flash the blues at them and then if they continue...THEN stop them

    The North Carolina Highway Patrol recently wrapped up a traffic enforcement effort dubbed Operation Road Watch. The operation was aimed at improving safety and preventing auto accidents on North Carolina roads and focused primarily on issues surrounding large commercial trucks or big rigs.

    This was the third year the Highway Patrol conducted the operation and similar efforts are being planned for later this year. The operation ran from early last Tuesday morning through Thursday morning and concentrated on Interstate 77 because it is heavily traveled by commercial traffic.

    In addition to cracking down on violations committed by semi drivers, law enforcement was also on the lookout for passenger vehicles contributing to dangerous driving conditions. Many drivers tailgate or drive aggressively around large commercial trucks, but they may not realize that the weight and size of these trucks makes them extraordinarily dangerous if involved in an accident with a normal sized car.

    I realize that the officer's judgment is what determines whether or not someone gets cited for something, but I see no reason to drive differently around them than I would around anyone else. He was definitely driving below the limit, and I see no reason why I should refrain from passing him in that instance just because he's a LEO.

    I'm a defensive driver overall. I got boxed in by traffic in this instance.




    Could be. But again, I wouldn't characterize backing off as we passed the semi aggressive nor tailgating. But I guess this could be related.

    This is something i routinely have to explain to folks...but the speed limit is the MAX allowed safe speed if conditions are favorable...

    it is not a requirement...nor is it always ok...

    if the speed limit is 60...and there is traffic and the officer is doing right at...or even 5 below...you should still refrain from passing the officer



    i agree that you shouldnt drive any different just because there is a patrol car present...however care should be taken to ensure you are not violating traffic laws while an officer is present

    no one is perfect and shit happens...and you may have a pretty good chance in court if you go or hire an attorney...

    would i have written you a ticket? doubtful...but if you irritated me (he couldve been having a bad day...who knows) i will find a reason to put you on the side of the road...

    personally if i was the officer...and you did that...and i made the decision to stop you...it wouldve been for something like too fast for conditions...youre gonna have to tailgate the crap out of me to get stopped for following too closely



    on the other side of the fence...before i was LEO...i was stopped for following too closely...i came up over a hill and encountered traffic...was slowing down from 70 to 45...ran up a little close to the car in front of me (less than 2 car lengths) and we passed an officer on the side of the road...him and i shortly thereafter had a roadside chat and i explained how i couldnt see the traffic before i came over the hill and didnt want to brake any harder because of traffic behind me...he wrote me a warning ticket for following too closely...

    personally...if i were you i'd probably either hire an attorney and/or request a jury trial...granted we only know your side of the story...but from what you've said...its a questionable ticket and a jury would probably take your side...a lenient judge would also probably do so (like any of our traffic court judges)

    I'm of the same opinion - this could be called either way (an infraction or just innocent driving in a bad situation) depending on personal bent.

    In any event, thanks for the input. I'm mulling the options, but it'll probably end up being a lawyer. Again, I'm not really concerned about the fine, it's insurance I want to keep down.

    depends on the state. you can get a ticket in some states. Some states have signs on the interstate instructing motorists to stay in the right lane except to pass. sadly, people still stay in the left.

    i don't think they teach this in drivers ed any more. it amazes me how many slow drivers drive in the fast lane.

    Your screwed. Use your probation law for 3 years to get it dropped and learn from you mistakes. Tigerfan is right, stay away from them drop back etc. Looking for trouble passing them . Get off the hwy and get gas, a burger etc then jump back on and do your 6 over.. :)

    They taught in driver's ed when I was in, but admittedly that was over a decade ago. It's one of my pet peeves too.

    I agree with "jandrews" (which is rare), that it could be a sunny day out side, with no over cast and clear skies for hundreds of miles all around. As well as no traffic on the road except the LEO, and the Officer is cruising 5 MPH below the limit, you are going 1 MPH below the limit, and eventually you catch up to him and pass on the lane to the left, two lanes going the same direction.
    And he can pull you over and give a ticket? It's not right, doesn't make any sense.
    But I know the vast majority of Officers are not as strict as this, and they are fine.

    But as far as I know, there is nothing in the Vehicle Code here in CA, that says you will be pulled over for passing an Officer and or get a ticket when obeying all traffic laws, and I would guess the same for NC?
    So why pull us over?
    I can understand if it's unsafe driving conditions outside, such as rain, ice, snow, etc, etc. But if nice and clear, no traffic; it's not right.

    But I don't agree or disagree with the Officer who gave "jandrews" a ticket, would have to see a video of what happened. It could have been a bad day, like "tigerfan00" said.

    while i also agree...slower traffic should keep right...there are signs stating such in SC...there is no actual statute against travelling in the left lane at or below the speed limit so long as you are not impeding the flow of traffic...and if youre driving the speed limit...youre not impeding the flow of traffic



    i would agree that there there is very little chance that there is any statute or code that says you cannot pass an officer travelling down the roadway anywhere in the country...HOWEVER...when you pass an officer...he will more than likely pay closer attention to you...and like i said...how his day is going will determine how hard he tries to find an infraction to pull you over

    there are TONS of vehicle statutes out there...and no one (not even me) can drive perfectly without breaking one here and there

    the best thing you can do is just slow it down a little and not pass him...its pretty simple...it may make your drive time a minute or 2 longer but you shouldve left earlier if you are cutting it that close...

    this of course does not always apply...like if the officer is travelling down a multi lane road and he's moving very slowly (ie looking for something or the like) but if he's travelling in the same direction and just a hair under what you would normally be driving...its not a big inconvenience to you to slow down...

    I gotta say....I pass Coppers all the time, if they are going slower than the posted limit. If Im going, for example, 71 in a 65, and am gaining on them, I pass accordingly. FWIW, I have never seen a cop going slower than trafic in the fast lane though. And I have never been cited for it.

    I pass them too.

    On the SoCal freeways, you will not reach your destination unless you are pretty close to the person in front of you. If you leave a gap - everybody will squeeze in - it's real annoying :rolleyes:

    And I think that might be the core of the issue there. If it's impossible to drive regularly without breaking the law, maybe the legislature should take a look at which laws may have outlived usefulness/practicality.

    That said, until they change 'em, I ain't got shit to say.

    There ARE too many useless laws here in CA, not sure about NC.
    I actually fell there is also way too many laws anyways, too much restriction on people.
    Laws are needed, but too much is too much.
