    Has anyone on here ever had any experience dealing with Toyota regarding an MSRP swap, buy back, or lemon law process?

    Heres my situation which I summarized in a reply on another post.

    I have a 2018 TRD sport and in March my check engine and track lights came at 11,500 miles. I couldnt accelerate without it stalling and shutting off. Had it towed to the nearest dealer where it spent 15 days in the shop. I documented the issue and sent a certified letter to Toyota requesting that they fix the car in 10 days or they'll have to repurchase it. They called the following day saying they fixed it by replacing 6 fuel injectors.

    Yesterday, it happened again at 12,500 miles almost 1 month after getting it back. I spoke with the service rep and they are bringing a "Field Service Tech" to look at it because they cant figure it out. I escalated my previous complaint to a case manager and flat out told them I dont want to keep the vehicle. I'm still waiting to hear back regarding my MSRP swap or buy back option.

    At this point, I'm beyond frustrated this has happened twice, in a two month period with a truck thats not even a year old. I loved my truck and based off some of the similar threads on here, it doesn't appear Toyota knows what the problem is or how to fix it. So basically, I'm looking to have it replaced or eventually file a lemon law suit and was wondering if anyone on here has had any experience dealing with Toyota regarding the above...

    It sounds (to me) like the dealership is trying to fix the problem and you just want to get rid of it. So, get rid of it.

    There was a recall on the CPS, had the same symptoms as your truck so it might be worth changing.

    At this point it's like dating an Ex that cheated on you... I don't trust it. So yes, I want to get rid of it... does that mean I have to come out pocket to replace the truck? Why should i?

    The only recalls on my truck were the master cylinder and now the pre collision radar... CPS hasn't come up.

    So you told them they have 10 days to fix it or buy it back with no legal case against them... all you did by doing that is force the tech to guess whats wrong.

    If your car had been in several times for the same issue, then you may have a case, but you jumped the gun by going to such extreme measures right away.

    Not yet... I'm waiting to hear back from toyota. It'll likely be an option if all else fails. I hadn't considered that. Thanks

    One of the criteria for lemon law in florida is 15 consecutive days in the shop... it's the first step to take in a lemon law case

    If they offer anything less than Blue Book, then I think you'd have a strong case with Toyo Corporate.

    oh wow, I think around here its like 4 failed repair attempts or 30 consecutive days in the shop.

    Working at VW we had people threaten lemon law all the time, but never met the terms.

    I drive a Miata.
    Lemon law protects the dealer too. They have the right to attempt an earnest repair.

    Oh, and selling well after letting them fix it is a hell of a lot cheaper than lawyering up for a lawsuit. There arent too many things in this world that will cheat someone out of more money than their own impatience.

    Give them the time to make it right.

    a lot of valuable info will pop up
    this does not seem to be an isolated incident as it seems this may be a reoccurring issue with not only your truck, but with others out there as well...

    Factory Blackout package, Soft roll up bed cover, Cheap seat covers, Front and rear dash cam, AVS in channel vent visors
    The worst thing you could do is send a letter telling them they have ____ number of days to fix it. That will just force them to send it out to satisfy your timeline.
    The best thing you can do is drop it off for repairs, let them have it as long as they need it, and if it stays over your states lemon law timeline, then you have a case.
    Sorry, but the customer does not dictate how long a repair takes. It takes time for a proper diagnosis, then order parts, then repair and verify.

    Yea, here in FL you need to meet the fillowing:
    15 consecutive days in the shop... at which point you have to notify toyota and they have 10 days to inspect and fix
    30 or more non-conon-consecutive days in the shop, or
    3 trips to the shop for the same reason
    All within the first 24 months

    That's what prompted the action... after some searching here, it seems like it's a know issue... I read a thread earlier where it happened to a 2019 with 400 miles...

    Cars are incredibly complex devices. How about being grateful to the techs trying to help you?

    No offence, but not everything in life is perfect. Maybe once this problem is solved you’ve got a single issue out of the way, and will have many years of trouble-fee ownership?

    I dunno, but people’s expectations these days......

    Yea, I pay good money for a car that has a great reputation and end up having issues where it leaves my family and I stranded twice and I'm supposed to be content after spending 15 days in the shop with no clearly no fix.... sorry for expecting the techs to figure out the problem in 15 days... don't know your thoughts but 15 days is a hell of a lot time!
