    It is not unconstitutional to make a custodial arrest (i.e., transporting to jail or court) of a person arrested for a minor misdemeanor (Atwater v. City of Lago Vista (2001) 532 U.S. 318 [149 L.Ed.2nd 549].), or even for a fine-only, infraction. ( People v. McKay (2002) 27 Cal.4th 601, 607; see also United States v. McFadden (2nd Cir. 2001) 238 F.3rd 198, 204.)

    As for the video, he can seize the evidence if he has probable cause to believe a criminal offense was committed on the video. He would have to obtain a search warrant to view the video, and once discovered if it was of no evidentiary value, to return it to the guy.

    148 PC Resisting Delaying or Obstructing Officer....Just got to be careful on trying to be all billy bad ass with the cops. They can arrest you for just about anything.

    Show that to the guy that has to pay to get his property out of impound after its been stripped by another douche that works at the yard for something he didn't do.
    If he committed a crime...arrest him.
    But don't give him some bullshit reason...then change the reason...then pound him into the hood of your squad car...then jam him inside the squad car closing the door on the guy before he's in.
    Thats all I'm saying.

    I agree, but the totality of the circumstances (dashcam vids) indicates why the officer is already on a fine wire. As stated earlier, he is instructed numerous times to put his hands behind his back and to get in the car, in which he does not. The officer does let his temper out, but everyone is human. He is just sick of dealing with those idiots.

    Thats all im saying too :D

    I wouldn't arrest a guy for an equipment violation. I would have pedigreed him, checked for wants and warrants, and seized the camera.

    Also, you are seeing the plate in the video from a lower angle than inside a vehicle, and that is why the plate is visible. The plate has to have an unobstructed view from a certain number of feet away or it is improperly affixed. The number of feet, I dont know off the top of my head.

    just because there is a law on the books that says it is ok to arrest somebody doesn't make it right. we have plenty of dumb laws in mississippi for example.

    1..A man may not seduce a woman by lying, and claiming he will marry her.

    2.It is illegal to teach others what polygamy is

    3.If one is a parent to two illegitimate children, that person will go to jail for at least one month.

    4.Horses are not to be housed within 50 feet of any road.

    5. It is unlawful to shave in the center of main street.

    6.It is illegal for a male to be sexually aroused in public.

    so would you arrest anybody for any of these crimes?
