Sounds like several good opportunities... restrictions or not, which would make you happiest?

Not having a tree fall on my trucks, me or my house. That would make me happiest.

Biggest thing is having interweb access. As long as there is line of sight with Redfeather, I'll get both AT&T and Verizon service. I'll be bringing my internet dongle thingy with me when i go to view properties. If no green lights, then pass.

Cut down any part of it that’s over your property line.

I gotta pay for it. I guess I could have the trimmer toss the shit back on his lawn.

Unfortunately it's the big branch that comes off the main trunk that needs to go, and it's all on his side. What is hanging over my fence isn't enough to prevent the inevitable.

It sounds like you're well on your way to moving and will be happy for doing it in the end, but if you want to stay where you are... maybe you could hire an arborist to evaluate the safety of the tree? Yeah it'll cost a bit, but could save all the money and hassle of moving.

I'm guessing the neighbor's insurance declined to pay out based on a force mejeur/"Act of God" clause. In essence, the tree falling was due to a superior force, not anybody's fault, and not subject to liability insurance. If you can prove that the tree was unsafe then it could be considered an act of negligence, which means liability.

Even if the branch that fell on your truck is a closed case, establishing that the tree is unstable or unsafe would give you leverage to see it cut. Or maybe the arborist says the rest of the tree is safe and you get some peace of mind.

But it sounds like you're set on moving, and will be happier for it. I vote avoid the HOA. The propane with NF land sounds nice. You might be able to add a wood stove, although those carry their own insurance headaches these days. About five years ago my folks bought a new house that came with a wood stove in an outbuilding and their insurance demanded they remove it. I think the same thing happened to the old potbellied stove in my grandparents' farmhouse after they sold it 10 years ago.

Windy morning. My shit is in the street again.
There are a large amount of broken branches hanging up there. I think they're still called "widowmakers"?
One of them fuckers wants to punch a hole through my camper. Not today.
The neighborhood has seen this drama unfold thru the years, many are slowing down when they drive by my house to see what else has fallen. Like literally pointing at the tree as they drive by, heads shaking in disbelief.
Maybe we can get a shame party going, sign a petition...

Gonna remove the fender today and see if I can make it less dented. Maybe body filler and a can of bedliner to top it off. Fuck it. Make the other fender match, call it a day.

you could bet your ass he would trim it then.
he has trimmed large branches in the past, but they were hanging over his grandkids playhouse. If you saw the pic, you'll see the trimmed off branches. But the shit hanging over me was left untouched.
