    I would say illegal.

I know in VA, front facing marker/clearance lights have to be Amber, Rear facing one's must be red. The whip is visible 360° and up above your vehicles body so either color would be illegal.

In almost allllll states, it is illegal to have ANY type of blue or red exterior lights of any type. The colored whip should be ok if it is not blue or red, but it does depend on the cop and his mood, but definitely a valid reason to pull you over and shake you down.

CA Vehicle code sections for street/highway
VC25250 - Flashing lights are prohibited on vehicles except as otherwise permitted.
Exceptions are listed in 25251 and subsequent sections; includes signal lamps, hazard lights, emergency vehicles, etc...

VC25269 - No person shall display a flashing or steady burning red warning light on a vehicle except as permitted by Section 21055 or when an extreme hazard exists.
21055 pertains to emergency vehicles and certain other vehicles (dump trucks, armor trucks, Caltrans, etc...)

VC25951 - Any lighted lamp or device upon a motor vehicle other than headlamps, spotlamps, signal lamps, or auxiliary driving lamps, warning lamps which projects a beam of light of an intensity greater than 300 candlepower shall be so directed that no part of the beam will strike the level of the roadway at a distance of more than 75 feet from the vehicle.

Off-highway, just about anything goes, except
VC38346 - A person shall not display a flashing or steady burning red or blue warning light on an off-highway motor vehicle except as permitted by Section 21055 or when an extreme hazard exists.

My head is spinning from looking through the vehicle code. I didn't spot the section pertaining to having to cover auxiliary lights - A CHP once pulled along side me after spotting my Hella driving lights on my bumper mounted light bar; he said the lens had to be covered while driving on the street.

I wouldn't be using this on city roads. Hell yah I can see how this would be annoying if you were behind someone with this. I just heard people catching crap for them in off-road areas.
