I believe they have to have a warrant to come in...but if they think there's shit going down do they not have the right to enter? the guy filming is clearly an idiot. Theres a possibility of domestic violence there

Wrong - There are exigent circumstances that allow immediate action by police without a warrant.

Without ANY back story as to the reporting source or original report it is impossible to have an intelligent discussion about this. Anti-police / Authority folks will say this is a clear violation of everything American. Pro-LE folks will say this makes sense. Neither of those positions will be 100% right.

 

unlawfull entry. period. no warrent. no bodily harm going on... they were not being asked in. If you can't see anything going wrong, get a warrent. Some one called about yelling and shit... still need a warrent

REQUIRED and ALLOWED are two different things. If the report was someone heard from outside the house screaming "No, Don't Kill Me" and then the two folks in the house obstruct any form of investigation thinking they can assert the need for a warrant that can be articulated as PC.

I wouldn't want the police in my house and I would do everything I could to prevent it if I was a criminal. If it was some kind of midunderstanding, I would at least cooperate with their investigation to clear up the problem, instead of being difficult and then screaming at them and trying to teach them law...

 

you can tell from the 'flavor' of the guys words that something is up...dang, if the police are responding to a domestic violence and/or disturbing the peace, they are not going to stand outside to settle the dispute...

prudent response for homeowner/video taker, especially if nothing is going on, just walk outside and defuse the situation pronto, if it is a mistake, hey, be pissed at the neighbor that called it in...

OP likes to stir the shiza for sure, lots of hostility, obviously the recipient of some kind of police action, maybe even found unwanted love while in the pokey (LOL, remember his bung hole thread), that could case a whole lot of hostility and wacky behavior..

Too an extent; the cops should be willing to speak without breaking the door plane as well. If after discussion they find/feel probable cause, by all means enter. But without a warrant and they way they treated this case was wrong IMO. I do agree the guy recording was being an idiot.
