Dealer "forgot" to charge sales tax on sale?

    I bought out my lease and financed the remainder on my 2016 on 4/5. Today, 4/23, the finance gentlemen I worked with called me and explained he "forgot" to charge sales tax when we signed the paperwork. I looked at the purchase agreement and he put N/A on the sales tax line. Is this the dealerships responsibility to pay since they did not collect at the time of sale? I understand that if they left the sales tax line completely blank, it could have been an oversight but since they acknowledged it?

    The purchasing experience left a lot to be desired. The gave me a competitive interest rate through toyota finance only to increase it after I turned down the $3000 extended warranty. Once the warranty was off the table, his attitude went from nice and business like to off-putting with little to no explanation or communication. It was if I did something really wrong towards him. Even his phone call to me today was rude. I would rather not have any more dealings with this gentleman and would like to tell him tough luck for his mistake.

    Anyone with any experience or opinion on this? I keep reading mixed opinions online. Some sites say it is just a "scam" to make the purchase price look better, others say it's an honest mistake.

    Although I’m not an attorney, you have a signed contract in effect. If something was incorrect, one of the parties should have noticed this prior to signatures and made a change. Basically, the dealership is responsible for the error, in my opinion...fwiw.

    Bump cause this is interesting. If it was me I’d say tough shit. Contract was signed with the agreed price. If he forgot something, that shouldn’t be your problem IMO

    ya that would be on the dealership. That was their error. Contract is signed. Think of it this way.. if it was an error in their favor, do you think they would say "OMG our bad let us return your money" they are called stealerships for a reason.

    A friend mentioned to me something similar.
    He’s 6 months into a lease (GM). He said the dealer just contacted him and said the wrong sales tax rate was applied to his lease and they want more money now..
    I know nothing about leases. Is sales tax charged on a lease??

    He told them to eat it..

    Just like above, I dont know the legalities of it, but if you signed and you left the building, its too late. I know this is a small potatoes example, but if you went to Wal-Mart and you saw the register didnt add tax, would you go back and pay it?

    If you have a signed contract in hand, and he's being a dick, fuck him.

    But since they will have a lien on the title as a loan, watch your loan docs and statements very closely....and maybe just double check your DMV paperwork.

    You can try asking /r/legaladvice... they are usually good with these types of questions. Otherwise like everyone else i'm leaning towards "tough luck"

    I’m no Dr Phil, but my guess would be that the reason the gentleman is so nasty is because he is under pressure to sell, to meet numbers, or simply to do his job right.

    Normally I’d be very reasonable and accommodating in a situation like this. But if they are being total d*cks, that changes things.

    They are just a collection agent for the State. Expect them to turn it over to the State and have the State come after you as part of your TTT process.

    State won't care about your warranty or anyone's attitudes, so don't bother with that story.

    However, they 'might' support your contention of the contract and look back to the dealer to collect.

    And if the dealer has not submitted the paperwork to the DMV yet, my guess is they'll hold it trying to keep you on the hook.

    You might want to use another dealer for your warranty work, if there is any warranty left. ;)

    I'd also start seeking credit union quotes to buy out the Toyota loan. Bet you can beat it.

    Six months? Sorry, but that dealer has some gall.

    The way taxes work on a lease is they are added to each payment. So, if you have a $300/month lease, you add sales tax to it.

    Maybe the dealer wants to collect more money on the lease, that’s all.

    If they were assholes like that I'd tell them that's some tough shit, contract is signed. I don't know if they have any recourse or not to collect it, but I'd roll the dice on that. They clearly acknowledged it on the contract but screwed up.

    Toyota finance isn't directly related to an independent dealer. Taxes usually aren't rolled into loans. This should be solely on the dealership. I would tell them to pound salt. I am not a lawyer, but I did stay at a Holiday Inn Express a few years ago.
