I seriously hope you get your truck fixed.
However, If I were you, I would never even mention lemon law to anyone. That makes you sound like you are just itching to get rid of it and blame something or someone.
Simply take it in, tell them your problem and then if they don't fix it, start the lemon process.

If I were the tech I would have just walked away after hearing the word lemon law. That means nothing but trouble for him.

In the future I plan never to mention it. Just did not want to wait months to get my truck fixed.

it is constant, never goes away while running. If I turn off the truck and start it, it is not there for like the first 30 too 60 seconds. A minute or two. I let it run for 20 minutes today idling after a half hour drive and it did not go away. I then turn off the truck and waited a few seconds and started it again and it came back with in about a minute. Far as I can tell it does not change with rpms. Does not get louder either when I rev the engine.

have you tried using a stethoscope or metal rod with your ear against it to pinpoint the source? that would be my next step. could be the plastic intake like the video i posted.

Have you taken it back to the dealer today? Has Toyota called back?

They don't call it a 4-banger for no reason! But in all seriousness, I agree that the OP threw out the word lemon way too fast. Just going off what I've read in this thread, my sense is the OP has unreasonable expectations and thinks they know more than they actually do. I'm not saying there isn't an issue with the truck, just that the OP's approach to getting a resolution is way off.

That is what I did last time, when they replaced my cap mount bushing. Already call them.

maybe i'm reading too much into this, but it sounds like they're saying you can optionally drop it off now, for an appointment in a month. couldn't you just schedule the appointment now, and come back in a month? why so much back and forth with toyota when you could just sit on it yourself for a few weeks and then have it looked at? in either case it's just sitting, your lot or theirs. having something on the books at least starts the process.

fwiw my local dealership leaves some time open every day for drop ins, you just have to get there when they open to nab that spot.

Sorry about your truck bud. Let me help you bit. You come off as aggressive. Learn to take a breath before you open your mouth. How do I know ? Because when I was younger, I was get the same way. Life taught me that people do not care if you are right. ( you probably are ). They care and will remember how you acted. Locate another dealer and make an appt. Show up at said appt. and just tell them you concern. Let them come back to you with the diagnosis . Even tip the service writer upon meeting them. Toss em a 10 spot for coffee. Be cool about it. Its a truck, that's brand new and has a warranty. I will work out. Otherwise get a v-6 next time. Lol only kidding.

Everyday that goes by only benefits Toyota and the dealership in the first year.

It can be if they are booked 2-3 weeks out (like you said they were). Everyone there is wanting their vehicle looked at and repaired. So, when they get to you, they get to you. Make the appt, drive the truck until your appt, and then drop it off. If the engine blows up before your appointment, then have it towed to the dealer and enjoy your free rental. You aren't entitled to any treatment the guy before you isn't...no matter if he is driving a 1995 Tercel or 2022 Land Cruiser. They are all first come, first served basis.
