    I'm not trying to mod.

    What I'm pointing out is that the discussion has long since departed the thread intention, and perhaps a new thread should be started, since the premise seems to have been met.

    The effects of using a cell or some device while driving are bad, and you should not do them. You should, you know, be DRIVING.

    Any situation where we determine through driving behavior, mental behavior, physical signs etc. that the individual is impaired either by drugs or alcohol or both, either substantially or to the slightest degree, in this case lets say drugs, we give them a blood test and release them on a summons to a sober party.

    No where in the MMJ amendment or amendment 64 does it say that driving high on weed is legal. So it gets enforced just like any other impairing substance.

    lol texting while driving is certainly a bad idea regardless of legality. Not really an argument there. Give it time it will be illegal everywhere.

    Guess it's a moot point though because there are plenty of other ways to engage in distracted driving that aren't illegal either.

    Nope... A text is not worth getting yourself into an accident and potentially hurting yourself or others. My gf does and it annoys the hell out of me. I tell her all the time she needs to cut that shit out.

    I am not going to lie and say i haven't, but only if its important and i am expecting the text, and i will reply at a red light. When i was younger i would txt and drive all the time, but as i got older and after some close calls i realized how dangerous it really was, and especially the crap you see on the roads when people are driving and texting and not paying attention to the rd. I get the urge to scream out to them to get off the damn phone.

    I ride a sportbike, so part of my survival mode is to actively check out what every driver around me is doing. I've pretty much come to grips with the idea that I will die under the wheels of a distracted driver.

    Texting/dialing is the #1 offense (legal or not) but there are dozens of other distractions - GPS/Stereo/applying makeup/eating/looking at passengers while talking (front AND rear seat)/applying nail polish, and my personal favorite:

    Every morning on the expressway, I see some suit-clad moron, in his Beemer 7-series, doing 80 (in a 65 zone, along with all the other morning traffic) READING THE WALL STREET JOURNAL! EVERY MORNING. Do you realize how small the text is in the Wall Street Journal? But there it sits, on his steering wheel. AMAZING that he's not been pulled over for it.

    Bottom line, though - you can't legislate common sense.
