    Yes we do, and in my state talking on the phone is not illegal, but texting is. I can't say for other cops, but for me, I may be going to call, get a "meet the complainant by phone" and handle that en route. Or be calling my commander to discuss options reference the call I'm headed to.

    i didnt read past this but this pisses me off, i was driving home for spring break and this idiot had both hands off the wheel dancing and singing when i looked in my rear view mirror...

    on topic i dont usually text and drive. at stop lights i might check but for the most part i dont care enough about responding to actually text while driving haha

    Texting while driving = violation = civil charge

    DWI = misdemeanor or felony depending on circumstances = criminal charge

    Like I said, different charges, both violations of law, both illegal.

    Are you suggesting that because one carries a higher penalty that it is "more illegal"?

    And as I mentioned, it's a tough call... there are degrees of distraction and degrees of impairment.

    The slightly impaired driver can generally hold it together well enough to survive the trip home... happens every day. Likewise, the texting driver can divert attention back to the road when needed... and that is where many academic tests fail at accurately replicating reality.
    Example, the Mythbusters test forced drivers through complex maneuvering (including backing through cones and parallel parking) while simultaneously engaged in solving highly mental problems with the other person on the phone.
    Unlike reality, they did not have the opportunity to say "hold on a sec" and put the phone down.

    But texting? That's as bad as reading the paper or watching a video. It is impossible to focus on the screen and drive with the road in the peripheral. The mental attention needed for texting causes the brain to ignore the periphery.


    Even the woman who's killed child spawned MADD said that she was not in agreement with the blanket reduction in BAC limits from 0.14 and 0.10 to 0.08 and 0.04... it's not the drivers in those ranges that are killing people (her comment).

    Frankly, knowing that there are people driving out there with "pot cards" scares the shit out of me... but so do Smartphones.
    There are any number of valid reasons that a PHONE may be needed on the road. 911 events happen. Passengers have phones.
    But I agree that when mobile, texting features should be disabled.

    its two separate kinds of charges, dui is criminal, and texting is civil. which would make dui more illegal since its a criminal offense, while texting is not. i am not failing to see your point though, you are right as well.

    so... how do you guys deal with the whole pot situation? your dept oughta arrest someone for it, and sue the state. once the case gets to federal supreme court, federal law will preempt CO state law, and it will be illegal again :cool:

    not that simple, but you get the point ahaha

    Hasn't happened with California's medical pot law yet.

    They can't even shut down the dispensaries unless they sell OTC to an undercover.

    So, how long has it been since someone addressed the the threads title...and talked about texting while driving?

    It seems that things have gone awry.

    The original point seems clear and agreed upon...yes? You shouldn't use a cell device or tablet or whatever while driving!

    What is a measure of illegal or civil or criminal or whatnot seems secondary to me...

    I admit I text while driving. I'm surprised it isn't a federal law yet. It's completely legal here in Missouri.

    What I'm pointing out is that the discussion has long since departed the thread intention, and perhaps a new thread should be started, since the premise seems to have been met.

    The effects of using a cell or some device while driving are bad, and you should not do them. You should, you know, be DRIVING.

    Any situation where we determine through driving behavior, mental behavior, physical signs etc. that the individual is impaired either by drugs or alcohol or both, either substantially or to the slightest degree, in this case lets say drugs, we give them a blood test and release them on a summons to a sober party.

    No where in the MMJ amendment or amendment 64 does it say that driving high on weed is legal. So it gets enforced just like any other impairing substance.
