I don't hate attorneys. They're your only friend when you show up to court. And public defenders often have the hardest job among attorneys, given that you don't always work with the most stellar examples of what an upstanding citizen should be. When the cops are involved I say lawyer up first and ask questions later (also, answer questions later).

There. Flogging complete, enjoy your day.

I'm wondering that too.. I doubt this would fly in Phoenix but who knows. I find it way more simple to say 'no'. and then be on my way.

I would hope, though it's clearly not always the case, that police wouldn't engage someone doing this in his pissing contest. They could have hassled him, but why? He wasn't doing anything illegal; he's clearly looking for a confrontation, the police should be smart enough, not to mention impartial enough, not to take the bait.

The fact that there are police out there who would rough someone up for asserting their rights is the reason people feel the need to assert their rights in this manner. You get what you give.

Wow this is still going? I believe that there is a time and place to keep your mouth shut and not talk to the police, a shooting for example even if in self defense, but this guy was just trying to show his ass for no reason. If he feels so strongly about DUI Roadblocks being illegal there also is a time and place for it, mainly city council and when they have open meetings where one can go and try to have something changed. It has been mentioned and linked that the Supreme Court finds it justified and legal so in this case it's just a guy stroking his own ego a simple "How are you this evening officer?" And a "No" if he had not been drinking and a pair of shiny cuffs if he had and is over the limit.

Police are trained to lie, especially at check points.

They are trained to say "I smell alcohol on your breath" and also "You are slurring your speech"

That is one reason why you dont say ANYTHING at a check point. If this man had said anything then the police would have LIED and demanded he go to secondary inspection.

The cops hate it when you beat them at their own game using God given rights.

He's a douche canoe. Not because he's refusing to answer questions, that just makes him a pain in the ass to the average cop. The reason he's a douche is he felt the need to post the video on the internet. No one did him wrong, he was treated with more respect than he gave. No reason to post it. I could see videoing it, just in case, since he certainly knew he wasn't going to be popular with the cops, but posting it is something a douche bag would do.

Fuck this shit, I'm out. IMO Bottom line is that Law Enforcement Officers as a whole are good people it's the few bad ones that ruin the reputation of the rest. All they do is enforce the laws and assholes such as this guy just make their jobs that much harder, but it's what they love to do because they sure as hell ain't doing it for the money; though it's good money just sometimes a hard day's work and sometimes they give their lives for it just in the hopes that the world will be a better place for the people they serve.

Despite what anybody thinks, under current statutes checkpoints have been upheld as constitutional and that is the law whether you like it or not. Until a new precedent is set and it gets reversed, you will have to put up with the "hassle" or satisfaction of knowing you are a little safer, depending on which side you are on. That being said, I can continue.

Just curious (from a sociological perspective): if being forced to stop at a checkpoint and go through it is not a burden, then how is it a burden for him to do the same to the cops and make them wait?
The difference is you committed a felony. What did this guy do? Nothing illegal for that matter. Since you "shot" someone you are not just a douche bag but also an asshole, that is assuming it was not in self defense.
Wrong. You should never speak to an officer without legal representation. The point is the 5th Amendment was not only created to prevent guilty people from incriminating themselves; but, that it is also meant to prevent an innocent man from incriminating himself for an ambiguous reason.

It's not necessarily a burden on the cops, it's a burden on the rest of the people behind him that just want to get on with their night. :p
