    Either way, if you had two beers, you should be under the legal BAC level assuming you at least waited an hour and had some food and peed before driving. At least I think, I don't really drink so I don't know. :p



    If you're over the legal BAC level, even if you're not "impaired", you shouldn't be driving. Anything could happen.

    Local cop did this to my gf when i was at work. She was washing her truck and he pulled up, looked into our garage, asked us who we were, what we did, etc. she was very troubled by this. The US is very much a police state.

    The 5th amendment says you do NOT have to say anything that will incriminate yourself. (it does not say "exactly" what that could be)

    Your Meranda Rights give you the right to remain silent, and "anything you say can and will be used against you"

    Therefore this guy was smart (does not matter if he was drinking OR not).

    And since the cops really can not hold you without arresting you (well, they can, but only for so long), this guy asking if he was free to go was also a smart move.

    I applaued him!!!

    Wow - kind of surprised that so many think the guy is an "asshat." Was there probable cause for a stop? No. Was he being detained subsequent a lawful basis for a stop? No. Did he demean or disrespect the Officer/Sergeant in any way? No. So, what is his sin? Oh - I see - he is asked a question and didn't answer. In other words - he exercised his rights that are provided in the Constitution. Should he have answered? His choice.

    Is there harm in simply saying, "No." Well he clearly thought he had no duty, nor did he, to reply to a clearly self-incriminating question. The Officer, and Sergeant, acted in a completely professional fashion and the matter was disposed of. What surprises me is some of the strong reaction of some responding. Have we slipped so far down the "giving up liberty for security" that we feel we must answer to any Officer's question just because, "we ought to?" I am glad he taped it - so perfectly legal from his own vehicle in public space (by the way - the same theory that the police tape all we do from their cruisers and I don't hear much complaint about that, especially when it makes for such great TV).

    The Officer and Sergeant acted professionally - the Driver acted well within his rights and all is well. Would I have acted the same way? Probably not. Is it possible that I could have, and had the right to? Certainly. That is the beauty of it - he had the CHOICE and the CHOICE was respected. Kudos to all who participated - and the dialogue we are able to have regarding the driver's CHOICE. Concepts like probable cause, reasonable suspicion, "fruits of the poisonous tree," and casual contact all come into play here - it is a complicated world we live in - but the simple fact is - the Driver's silence can NOT be interpreted as an admission or denial and he was allowed to proceed. Oh, and by the way, for those that wonder what harm there is in a simple, "No," it's a story and leaves the answerer open to more questions - a rabbit hole that law enforcement knows that once begun they now have the upper hand. And, and it is a possiblity, maybe the Driver did have an alchoholic beverage and chose not to answer.

    I couldn't agree more with that. I have no doubt that he was well within his legal rights to not answer. I just think it was completely unnecessary and wasted a lot of time for all involved, including the people waiting behind him that don't give the cops any trouble and answer and go about with their business. Was he just trying to prove a point? Why ask for their names and unit numbers? Why did he record it on camera? He was obviously trying to accomplish (or instigate) something.




    Anyways, we've already established all of those things. :laugh:

    This guy is a douche, yeah he doesn't have to answer but he's wasting everyones time by acting like a douche bag. He's holding up the people behind him and wasting the police officers time. The only people who should be applauded are the officers for being professional. I probably would have made him take a breathalizer or feild sobriety test. If he refuses to do that you can take him in and tow his car, cause hime more problems. But I'm an A-hole.
