    I beleve that with the officers observations deturmined that he wasn't UTI.
    I support checkpoints, and after a supercross event this January fully support that the local PD is protecting the general population. It,s just stupid to let people drive after consuming that much alcohol. I,m surprised that ..... in California that an local pd hasn't been sued for not doing enough to keep drinkers off the road.

    He's not an asshat for sticking up for his rights. He's an asshat for going about it in a douchey way. The officer politely asked a question. So a polite, "Am I being detained?" would have been the way to go. He asked it anyway, so clearly he didn't have a problem talking to the officer. Silent treatments are for 15-year-old girls.

    I'm 100% fine with police videos. I think all police interactions should be taped. Traffic stops, interrogations, and every square foot of a prison (except for the bathroom corner of the cell). Protects the citizens as well as the officers.

    Let me try to muster a tear.... nevermind, it's not wroking.

    Yeah, less cops means fewer to respond to legit crimes. On the other hand, from my experience the police have a lot of time on their hands. I've seen several occasions where there was 1 cop there to do his job and 4 or 5 there because it was the only call in town at the moment and they had nothing better to do. Perhaps we can spare a few.

    Hit it on the head with this one. The guy was well within his rights to do what he did but he could have said something along the lines of pleading the 5th amendment and will not confirm nor deny that he has or had not had anything to drink unless he had his lawyer with him. But a simple no would have sufficed unless he had actually been drinking in which case by saying no he is lying to the officers and interfering with an investigation and is grounds for arrest.

    Maybe you would change your mind when the response time to a robbery in progress to your home is 45 min.

    I am always in favor of more cops, LEO, those to enforce the law. There are robberies weekly at my University, morons who drive 20+ over the speed limit, and I wish for my safety and the safety of others there were more to crack down on those who are careless and want to do harm to others.

    Just calling it like I see it. Perhaps if those other cops had stayed in their area and not been there just to gawk I'd feel differently.

    I was raised by a dad who watched a kid get shot in cold blood by the National Guard at Kent State. Cynicism is a way of life for me.

    Why? Because they're out watching the fallout from a bar fight instead of patrolling their neighborhoods?

    I'm not trying to be a jerk, I've just seen the police do some really derpy things, and still expect to be treated like heroic angels. Hell, I had a friend in high school who got arrested for marijuana possession. He was only charged for half of it. The cop stole the other half. This is who we have protecting us.

    Yup. That's what I mean. They're people, not paragons of virtue. I don't expect them to be perfect, but they should follow the law because they're supposed to be enforcing it.

    Umm...I don't want to start an argument but they (the cops) have no grounds "not being recorded" (that sounds a little wordy, but you know what I mean)

    I used to work at a television station here in cleveland (until a computer became cheeper then me). By law, anyone can video any activity that is in public view providing that you are videoing/filming it from a public area (or your own property). So the driver in his own car on a public road, filming out his widow is legal, no matter what the subject is. (this is not to say that filming into someone house while zooming in real tight, is legal, because that would not be, that would fall into the catagory of being illegal, like peeping, even if done from the sidewalk or street. BUT if you are filming in a wide shot, and video with relatively the same detail as you would see with your naked eye, then that is legal. If your doing something in your house and don't want people to see, close your drapes, so says precedent's set by judges findings. Next time you watch the news, pay attention to how they shoot houses, especially night shots where you can see inside the house.)

    In addition, there was a recent court ruling (not sure about the state) where someone filped off a cop and was arrested for it. It went to federal court, and the defendent won. The judges opinion was that police are represenative of a governing body and there for "are" the government, and since the government is open to the scrutiny and opinions of citizens, and the middle finger is considered "speech" (it caries a message), then the police are open to that "speech" and criticism and the defendent is allowed that right.

    Ive been stopped at a dui checkpoint once. yes I was a little pissed off because I was the only car out of a large group of cars stopped (probably because I was a young kid) but I wasn't a dick like the guy in the vid. Just told the cop I had a soda and some food. done with in less than a minute but it was still an inconvenience and i wasn't too happy they decided me instead of the other older people who they may have been able to get for dui.

    A good point. I've never lived in a major urban center, I'm from out in the sticks... at least relative to California. Northern Colorado (when it wasn't 100% city), Oklahoma, and now North Dakota. I'd imagine it's a lot different when there are more people.

    My late teens and most of my adult life until the last couple months were spent in Oklahoma, and the vast majority of the cops I encountered there... yikes. It's a bunch of good ol' boys with badges, guns, and persistent inferiority complexes left over from high school. Not all of them are like that of course. But enough of them are to make me want to know my rights and politely but firmly require the police to respect them.

    Miranda WARNINGS are a judicial precedent dealing with both the 5th and 6th Amendment...and the 5th Amendment specifically states "nor shall be compelled in any criminal case to be a witness against himself"

    Miranda warnings exist because there are uninformed people out there

    Check out my post in this thread #190 and watch the video's. Also, if you are arrested and not read your rights, can you then explain why the case is thrown out?

    I have a friend who is deaf. She was arrested, dui, and read her rights. She plead guilty, the cops told her she would have a lesser sentance if she did. Later, she had an attorney that took it back to court, and another judge threw the convition out, stateing that she was never merandaized because the cops read her her rights. She's deaf, they needed to show her them in writen format!!!
