    I think as others have stated...get a lawyer started on this and see if he/she can get footage of the gas station. It might really help identify the night that your gf was indeed your DD and you were simply getting something out of the back. Regardless, this is a learning situation for all of us in the future should you need to get anything from a vehicle that you have a DD for already.

    Exactly. Keys in the dash while entering from the drivers side, arrests in that case have happened many times before without the vehicle moving an inch.

    Yup. One of my friends got a DUI in a bar parking lot because he turned the keys to ACC to listen to the radio while he sobered up.

    On an unrelated note:

    A different friend nearly got kicked out of the Air Force for getting a DUI on a shopping cart that was later settled to 2 moving violations (running a stop sign and 5 over the speed limit) and a public intox charge.

    I was thankfully warned about this "intent to drive under the influence" awhile back.

    I was told (but Im not lawyer so take this with a grain of salt): If you are ever to drunk to drive but need to nap / be in the car, go in the passenger seat, & put keys in the glove box if you are napping, so you can demonstrate no intent to drive.

    I’d rather advise an Uber, lyft or taxi and get your car the next day.

    A lot of bars with their own parking lots will let you leave your car there until sometime the next day. I've done that once or twice.
