    That is always better advice, just sharing what I was told when a group of us went to a bar and my buddy was done and wanted to wait/nap in the car until the group was done and the DD could drive us home. The lawyer in the group told him to nap in the passenger seat, just as a precaution.

    I’ve always been told to chuck the keys lol, or just leave them somewhere totally outside of the vehicle if another form of transport is unavailable.

    Most of Canada is now an automatic 48 hour suspension and vehicle seizure at .04 or .05 depending on the province. So don’t drink anything at all and drive. Not only is it solid advice but it’ll save you a $500 ticket, towing fees, impound fees, and possibly your job since I know my company fires anyone that gets a DUI conviction.

I know you weren't driving but did you have POSSESSION of the keys? It is ultimately his word against yours however your GF could testify if you go to trial. Most of DUI cases are settled before they go to trial. I would get a lawyer it sucks and it will cost you somewhere in the ballpark of 2-3g's I am estimating. Not all Highway patrol man have cameras in there car. It is also up to the officer to arrest you based of not because you are drunk but because you are to impaired to operate a motor vehicle. Its up to you to prove otherwise "guilty until proven innocent."

    Colorado has a DWAI limit of .05 too.

    All I have is the ticket he gave me. I guess i get the arrest sheet in the mail? Ive never been arrested so I dont know how things work.

    The Keys where in the car. I did not have the key's, I was outside the car when they pulled up. We pulled over on our own to get Asiprin out of the trunk. I did go to the drivers side to pop the trunk,the button is in the door panel on the Mercedes.

    After they put me in the car and drove to a patrol station non of the breath testers worked. So we went to the Jail where I was told i could give blood by choice or he would get a warrent and force me to.

    Best of luck, like everyone else said, get a lawyer so they can at least protect your driving privileges until the case goes to court.
    Depending on how long ago you stopped drinking will determine your bac from the blood test. Your bac continues to spike if you just stopped drinking and a lot of time the blood test will come back higher than the breath test since it was taking a later time.
    They can also get you for a wet and reckless even if you're not over .08
