    I'd tell the reporting party that its a civil issue, based on all the evidence in the thread, he was operating a legit company at the time he acquired the money and made the contracts. I've seen someone experience this first hand, just happened to be my father who was the legit company owner at the time.

    I don't really understand this. What reporting party? Its certainly a civil issue re: breach of contract. What point are you trying to get across?

    Aside from that - does anyone know how many bumpers remain unfinished and undelivered?

    People are saying go to the authorities, police are the authority, people going to them are the reporting parties...

    As in, this isn't a police matter, seek legal action civilly, not thru police.

    Oh I see what you mean - thanks for clearing that up. I think the cost may be prohibitive for most people to sue him (see below post re: filing fee costs). That's why I was wondering how many people were out their bumper, b/c they could all bring an action as joint plaintiffs and spread out the court costs.

    Generally, costs and attorney's fees are not recoverable in breach of contract cases, but its certainly state specific as some states enacted statutes allowing for this. I know there are guys following this thread that know the OP. I really think the best thing for all would be to have one of those guys try to act as a intermediary and get this resolved (maybe this has already been tried :confused:).

    I'm not one of the guys bashing, though I understand those that are. I'd just like to find a way to help those who are out their money to either get their product (preferably at a discount due the time delays) or get their money back and let Tim limp away and learn his lesson.

    I think you're right, those who are out cash without product need to come together as a collective and file I guess it would be a class action type suit against the OP, if they want to take it that far.

    It wouldn't be a class action as that has special requirements and a much larger pool of injured parties. It would be a multi-party suit where each injured party is a plaintiff (i.e., Jon Doe I, Jon Doe II, Jon Doe III, collectively plaintiffs vs. Tim Teran and Elite Offroad Products, Inc., collectively defendants).

    I'm wondering if there are really that many people without their bumpers at this point. I'm wondering if it hasn't spiraled into the crapfest it is b/c we've made it that. I don't see many people anymore chiming in that they don't have their bumpers. Granted, the page count grows in this thread quickly and I don't read everything. They may still be out there though.

    I would have sued a long time ago if this was me. Principle of the matter, even if I had to pony up all fees. No way he would just get away with this. Had to do this to a landlord who tried to keep all our security deposits back in college. Sometimes people need to be brought back down to earth and the only real way to slap someone back into reality is that subpoena slapped in thier face. Plenty of evidence just in this thread alone to make it a quick case.....just my $.02 and I don't care to hear any comments so unsubscribed lol :) goodluck to all those who haven't received their goods.
    Really makes me angry for you guys and upset at the OP everytime I see this thread pop up and nothing has been resolved.

    One of Tim's last post in this thread claims the remaining two bumpers will be made and shipped soon.

    I too wonder how many people placed orders for bumpers, paid for them, and didn't receive product.

    I met a guy last Thursday who isn't on this forum who ordered a bumper last year, and hasn't heard anything from Elite.

    But I guess he got the info to order it from TW? I didn't ask him a whole lot of questions because I though he was bullshitting me, til I saw this group buy. :facepalm:

    If the dude I met in Upper Lake, CA w/ the white 1stgen reads this, I suggest to follow the recommendations in the posts above and proceed to file a civil suit.

    Just figure I should throw this out there but if there are multiple people who do feel like they want justice for this wrong and are not going through with it because of legal fees let it be known that the court cost would be put into the settlement. I don't know if somebody already mentioned this or not but might as well make sure lol

    Dang this is pretty nuts, I saw an elite bumper on Google search and got interested especially when I saw this thread until I scrolled to the last page!
    If it's any consolation, the website said they aren't taking anymore orders at this time, I feel like it was a small business that got ambitious with the group buy and had been totally overwhelmed by the amount of orders..
