    used to have - 99 2.4L I4 5 lug & 04 prerunner v6
    to be fair, were any of those cars 15 years old? I think that where the problem is, they want to devalue it as if it were a 15 year old car and not a taco truck that still has good value

    I've stopped talking to bozo in Kansas on the phone. He only calls me at work and he is a trained smooth talker. I'm not. I rather use email, but he is a pro. I would sure like to speak to someone else. That conversation goes something like this:"Mike, were going to fix your truck." That will not happen at a shop with Farmer's written on the door.

    I think I might win anyway. I got the scrap value out of him. Now he has to fix the CCC and can't he change my buy back. I like how that worked. Damn law, sometimes it works in my favor. I asked him that in our first phone conversation but he could not stop talking about other BS. When I first read that I didn't know why it was in the books.

    The insurance adjuster works for his employer, Farmers if I remember correctly, he does not work for you. There are laws regarding bad faith dealing, what they are in your state you are going to have to research yourself. I got a check from Wawaneesa for $9.5k in 1999 for a 1976 F250 full time 4 X 4, 6 mpg, regular cab truck. I knew how to document, what to say, in short, I did my homework. Best day of my life having that truck stolen.

    The mileage deduction is standard, should have been equal to the depreciation deduction used by the IRS... close to .50 cents a mile... this is a business transaction for them and an emotional one for the insured. The problem is that you cant replace her for what they are offering, they know this is your primary transportation and will use that against you... you probobly insured this as a personal/pleasure vehicle and as such their obligation for rental vehicle of choice is up to them, they can put you in a Prius.

    Interesting. I am looking at buying a 2003 for 12+k at the moment. So I go on a Tacoma forum to read on this truck and see this gentlemen clearly getting taken adventage off by the insurance company.

    So, now I am thinking, the guy gets rear ended. Not only is his truck totaled, but the car his truck hits is apparently totaled as well. Imagine the force of the impact (actually two impacts -- front and back) and they guy suffers no ill effect on his health?! Say WHAAAAt?!!!! I am not a doctor, but I say it is highly unlikely this gentlemen's body didn't suffer any consequences of this unfortunate event. I'd say the gentlemen need to see a doctor as soon as possible. And not just any doctor, but one who is an expert in traumatic injuries. Oftentimes, the stress of trauma hides the physical and emotional damage the body suffered. I think you should keep your priorities straight -- stop the BS talks with the insurance company and go see the professionals who know how to make you whole in this situation. Yes, go, no, RUN to see a lawyer and a doctor. Believe me, you won't have to worry about no stinking farmers insurance company after that. Just do it. It won't cost you a penny. And as far as the insurance company is concerned, paying you the fair value for your truck (or getting it fixed) will be the least costly of their worries.....

    I did get shook up. My hat fell off. It takes a 30 mph gust to do that. The second impact was soft. I hit the trunk an it just folded. I Could feel me stopping him with my breaks like heavy trailer as I watched me get pushed into the other car. I was not hard on the breaks until the full contact of our bumpers. His breaks were locked and I could hear him coming so I had braced for initial shock. We all managed to get off the street, both trucks just hopped over the curb but the car had to pull forward to a cut out. We made sure everyone was alright and we were. The hospital was just across the street. I felt a little sore for a few days after. I should have went to the hospital. The lady I hit said she was pregnant and would like to get checked out. Her husband showed up as the cop was getting info from all of us. Everyone was honest. Only one of us got a ticket. I know because I have the report. The cop told me to leave before anyone else had. The car probably got towed. The tail lights looked like they would fall off. Mine had lost a lens in the street. Her's was parked right in front of the same shop I took mine too.

    I'm not going to sue for their criminal behavior. The only thing I can do is sue for true value of my truck. They do this all the time and just get away with it. It's getting kind of personal now. I see trucks like mine over $10000 all the time. Some don't look as good as mine. Good examples sell up to $15000. Honestly mine might be $8000. If I can prove it it will not be a total. Their assessment did say my tires were wore out and that was blatantly wrong. I wonder what a judge from this planet will think of that?

    This, theres a ceiling price for about every make and model as to how much $$$$ an insurance company is going to invest before declaring a total loss, your wreck may have hit that ceiling price, that said , from whats described as damage wouldn't scare me a bit , (unless of course the engine is sitting in the front seat/frame twisted like a pretzel,etc.) I'd buy back the salvage & get it straightened out on the cheap (cheaper)..

    Utah law states if the repair is over 75% of the value it's a total loss. If bozo doesn't screw with the savage price I'd be an idiot to not pay $2400 for this truck. But bozo will. Bozo probably will not like the numbers when all the red exes are changed to check marks in the CCC software. My truck is loaded.

    No one is suggesting any criminal prosecution here. Look, I don't know what you do professionally, but if a guy who has never done what you do professionally try to do what you do, do you think he would do a good job on his first try? What makes you think you can deal with the insurance company on par with them? The insurance company is THE expert at what they do. The insurance company is not on your side here. It's not even your insurance company, if I got you correctly. Why not give it a try and call up an "accident" lawyer from your local yellow pages? It won't cost you anything and it won't take you more time than what you are spending on your communications with the insurance company. I think you are making a mistake by not doing that.
    BTW, looking for advice on an insurance dispute on a truck forum is not very prudent either. So, you should get your head checked out -- this is my attempt at good humor, so please don't take offense :)

    Playing with the numbers it seems even if my truck's real market value is $8000 they still save money scraping it. They have no regard for the law if it will save them a buck. I'll probably have to fight it anyway.

    I've found out the insurance claims animals are a very cold hardheartedly vicious and unreasonable creature. The only formidable opposition to which is another insurance claims animal or an unbiased judge.

    I just want to get this accident taking care so I can up my policy to full coverage. I don't feel safe on the road without it anymore.

    Give the insurance company a check for whatever your deductible is; tell them to go buy one for that + their $5k, and let you know when you can pick it up.

    Worked for me years back with a 1975 Fiat 124 that had been rear-ended--they didn't actually get me a replacement but they upped their payout to where I could...

    All insurance companies will allow you to buy it back, but it depends on what state you live in. Some states will not let you buy it back, not the insurance company.

    High mileage equates to a significant decrease in value. Ask the insurance company to send you their comps if they haven't already. You can also find comps to send to them to see if they will bring your value up.

    Thats not exactly true. Otherwise everybody would refuse to settle, and keep racking up $25 a day, indefinitely.

    Having them rerun your CCC with the correct options and condition is where you should start. That may very well get you what you are looking for. I've worked with CCC alot and the adjusters who go out don't always do a great job, which is obvious in your case. Look over the CCC and make note of every thing that is missing or incorrect. Have them update it and then see what the value is. I've seen CCC's jump significantly when options, and trims are changed.

    Shame that it appears an injury needs to occur to be made whole.

    In my state, the police will not even write up a report or give a ticket unless there's an injury. And with the meager payouts by insurance, you almost need pain & suffering payouts to get the proper amount you need to replace your vehicle.

    That's probably why fraud occurs.
