Fender bender = Pro tails and steel bumper

    So I was backing out of a parking spot at the supermarket and hit some lady that was hauling ass down the row of parking spots. Thought it was surely my fault but a witness said the lady was flying and definitely should've seen me. Who knows, that's why I have insurance.

    Good news is I've got a busted taillight and left side of my bumper is fooked. Small crease in the left bedside. The only correct fix I can see are swapping in Pro taillights and a @Mobtown Offroad rear plate bumper!

    Anyone ever been in an accident like mine and who is ultimately at fault? Hours after the accident she tells me her son's head hurts and he had a seizure so she took him to the ER. She doesn't have a driver's license but had insurance for her borrowed car. Seems fishy to me because he was fine right after.

    She's got no license? Sounds like whoever the owner Of the car she was driving better have good insurance, she shouldn't have been behind the wheel in the first place.

    If she was driving and has no license she should not be driving. If the witness said she was speeding she could be at fault. Tell your insurance co and let them take care if it...

    So, the lady you hit was driving without a license? You should be contacting a lawyer in this situation. Even though you are essentially at fault because you were the one exiting a parking spot, had she not been driving this would have never happened. Did the cops issue any citations at the scene?

    I think ultimately I'm at fault too since I was backing out. According to the witness it was her fault. Didn't contact the police. Think it's better suited for the insurance.

    It may have seemed like a good idea at the time to just let insurance handle it, but it would be much easier with an official police report. Even if you did receive a ticket yourself, it would help your situation. Did you at least get contact info and statement from the witness?

    Got the driver's info and info from the witness. Last time I was in an accident I got rear-ended on the freeway and once CHP responded they said there's no need for them to respond to fender benders. Each state's different I guess. Today's accident happened in Texas.

    Now that you said that, I guess if the police were called they may not even respond anyway. So I guess just exchanging insurance info would be all that was needed.
    OP, I hope everything works out o.k. for you and you don´t get caught up in a mess.

    Gonna be Mobtown's plate bumper for sure. I've been eyeing it for months. Just needed the justification. Same for the Pro taillights.

    Her insurance won't do anything, because she was driving without a license. Hopefully you have uninsured motorist. At least that's been my experience in WA. You must have a valid license when operating a motor vehicle as part of your insurance contract.

    Wasn't her vehicle and she's not listed as a driver under the policy.

    I'm not worried about the accident. What concerns me is that after the accident her kids were playing and laughing and she's telling me she had to rush one to the ER because he was having a seizure. I'm thinking a scam type lawsuit might be coming my way.

    That's even worse for you. The insurance will just say "she's not the policy holder" so they have zero liability. Shame on the policy owner for letting her drive.

    As for the seizure, let your insurance sniff out that scam. They have more money to fight in court than she does.
