Finally ordered my Kings and then this happened

    Terms and conditions protect the seller from unreasonable buyer blowback. A company cannot take your money, mislead you about their inventory and then refuse to offer you a refund without losing out on 20% of what you paid. Everything about that screams civil suit. Again that’s like if I sold you a product I didn’t have, told you no cancelations and then tried to keep 20% of your money when you say you want to cancel. Business doesn’t work like that.

    That's a horrible idea. What time?
    I say this with a long history of retail management and supply cycle experience at Walmart and other retailers, and as a former small business owner. The intent behind the T&C you keep citing is to keep people from abusing the retailer. This costs money to the retailer in time and material. The T&C also requires the seller to act in good faith, and they have not. There is no disclaimer in the posted T&C that says this applies to items they don't have in stock or have direct access to. That is not acting in good faith, which is what they expect of the customer. As a small business they have the right to do as they want. But they also have the consequence of lost customers for acting in bad faith. It costs a lot more money to get a new customer that it does to keep a customer. I'm siding with the buyer on this. And that's from a former retail manager.

    Although I agree it’s a shoddy way to do business. I don’t think there is anything “illegal” or “suit” worthy here, other then you being annoyed or feeling misled. They aren’t keeping your money and saying you won’t get what you ordered, they just didn’t say it was out of stock or back ordered. Businesses do work like that, clearly... it’s just not always a smart way to do business.

    I’ve bought from Rouge Off-road in the past with no problem, in fact they were the lowest price on the item I got by a long shot. I’d buy from them again.

    Boosted Money Pit....
    King for most of the COVID has been shut down due to being non essential so its not shocking they are out of stock. Took me almost 2 months to get mine in non COVID. Most vendors put the order into King like folks have mentioned. Can always cancel but unless someone has them on the shelf it will probably be the same result.

    The act of not having something in stock isn’t suit worthy nor illegal and I didn’t mean to present it in that manor. Shit happens and I get it. But if a retailer cannot fulfill an order and then refuse to cancel without a hefty fee then you can potentially go that route.

    So not trying to be a dick here, just trying to get some clarification....but did it actually say in stock on the website? everything i've looked at for king and ome on their website says contact for eta...And i'm not saying they didn't but i highly doubt they changed their stock status in the last few days.

    Also where did you find this? i can't find anything on there website or even under a search showing they are closed or anything and there social media's don't seem to say anything... I need to get some front triple bypasses for august...so hopefully accutune can pull something off...lol

    Yeah i finally found it buried in their instagram, but they have been posting regularly since so who knows... Yeah i'm probably gonna call accutune on monday to find out.

    That eta status is something that’s new to me. Not saying it’s impossible I missed it but it’s not out of the realms of possibility it was changed considering I got pissed off about it over the phone twice

    I was going to bring that up...I even looked in the google cached results and as far back as I can see, the Dakars have said "Availability:: Contact us for ETA" I figured the OP would just deny it with no proof because he's the victim here damnit!

    Even if true does that excuse the behavior of the vendor in their ignoring communications from the OP? No. Has the vendor provided an ETA? No. Come on, man.

    Most of these offroad shops are drop shippers. They don’t actually have anything in stock, they simply place an order like a middle man. Secondly, Most king shocks are built to order so it’s rare for anyone to have anything from them in stock as well.
