    Bingo! Obviously fault charts vary state to state or province to province. The scenarios listed by those lawyers are very unlikely to absolve you from fault. Cop giving out tickets do not override the insurance companies fault determination. Most chain reactions where you struck the party in front usually end up with you being assigned a percentage of fault for failing to leave sufficient space. Brake lights are also a moot point. I drive manual and often use brakes much less and can come to almost a stop without depressing the brake pedal. Co-worker's dad drives manual and party who rear ended him attempted the brake light argument which failed quickly.

    This thread is taking some wild and yet wholly expected turns.

    I've calmed down a lot when it comes to my driving. Doesn't matter if I'm right or if the other guy is wrong, sometimes you have to retreat to save your metal. Now I just assume that everyone on earth is a shithead who refuses to secure their cargo and also wants to occupy the space I'm currently in. The older I get, the more I hang back and let them go right ahead. Please, feel free to pass and get to your shithead convention (and out of my little world) that much faster.

    And in those rare cases where its unavoidable, the dashcam is there.

    Yes it's standard procedure when there's a person with left-lane-love leading the pack of 20 cars behind them and is too scared to pass the semi in the right lane. Hell cops tailgate when they want to pass you. Just get the fuck over already.

    I'm thinking that most of the time, if someone makes a right on red into traffic and an accident occurs it will be that persons fault. In this case, unlike most rear end accidents, the person who is hit is at fault.

    It is the same in Va, and clearly it is there to protect the stupid. No doubt that if I targeted every idiot that pulled out in front of me, I would be on a first name basis with an insurance adjuster. Sadly, though people take advantage of it. I was the victim of what I was sure was an insurance scam. Woman pulled out in front of me and there was no way I could avoid hitting her. Witnesses even said she pulled out in front of me. Didn't matter, I was charged. Went to court and the judge dropped the charges. I thought it was over. Nope, got served papers from a sleaze ball legal practice wanting $500k for injuries related to the accident.

    if I walked out to the middle of the street, dug a hole, buried a twelve foot iron pipe, halfway, sticking straight up, filled it with concrete, welded spikes to it and painted it bright orange I would be ‘liable’.


    If you came along and drove straight into it, you might be ‘at fault’…
