The insurance company would deny the driver as they typically don't pay out for stationary road hazards. I think it's a fair expectation that drivers move at a speed that allows them to react to stationary obstructions in the road.

That said, in your scenario, if it went to civil court you could easily be held liable for purposefully creating a road hazard.

Yup. Doesn't matter how much of dickbag a brakechecker is, you're the one who put yourself in a situation where they could brake check you. Fuck around and find out.

On the rare occasion I'm trying to pressure someone out of the left lane ima hover that brake.

Not to call out OP, just generally speaking about more aggressive driving.

Add "Unprotected Left Turn". It faults the one which got hit in the rear.

So, like you said, there ARE exceptions.

Finally a post in this thread with worthy experience and advice. Drivers post pandemic are worse than before, and they werent good before. Ive seen road range increase, and my experience is to bite the bullet and move on with MY life, intact.
and i need to get a dash cam

I agree, within limits. I have unintentionally hard braked before though without rage.

In Florida, if you're going to honk your horn at someone you best have limo tint and at least two 20 round mags.

If it seems like it could have just been a mistake I just move on with my life. Not worth even getting annoyed over. We've all accidentally cut people off every once and a while. You drive past 1000s of cars in a week of commuting. You getting cut off could be the first time that person fucked up in two years. Less tolerance for people driving like assholes though. Of course with legit life and death close calls it can be hard to restrain the adrenaline rush in the moment.

I never ride ass anymore, it's asking for trouble.

I don't care who's fault it is, I don't care if the other guy is being a dick. All I care about is keeping my truck out of the body shop.

I didn't say it was ok. Matter of fact it's not OK anywhere. I just said it does happen. Just like brake checking, and being a passive-aggressive driver. That's really not what this thread is about. Everything has a consequence as the OP found out.

Under their law, brake checking is considered road rage.

Looks like damage is minimal but I'd be pissed too.

Similar thing happened to me yesterday, hauling a half yard of dirt some azzwipe pulled out of a gas station without even slowing down right in front
of me to get in line for the red-light - the weight in the back makes slowing/stopping on a dime impossible - but I made it. Unfortunately any hand
signals or horn honking these days can result in a full-auto-unload of a magazine into whatever you're driving so I didn't get my panties in a wad.

    This dash-cam - I gotta look into this -

I would think hitting someone in the ass is following too close lol. I used the law quote instead of actual code because A) It is fucking common sense and B) There are always exceptions, why is why we have lawyers.

And not applicable here from the OP’s description. Here’s the law in your state regarding this:

    https://law.justia.com/codes/south-carolina/2012/title-56/chapter-5/section-56-5-2330

A car turning right on red must first yield to oncoming traffic. Failure to do so is a violation of the law, despite the violator being the one who is impacted by another vehicle.
