Frame is cracking and I need help BAD

    I'd follow this advice. That's not safe for the road, and they should have never sold that truck in that condition.

    I just read it, and used would be covered only if within a year of the original purchase date. Looks like SOL. Bummer. Make friends with a welder, buy bar stock, a grinder, a stack of wheels, and beer, and start patching that thing up.

    If they refuse to help, go out in front of their business as many days as you can and make a big sign that says "You are what you eat. Thanks Maxcy's Auto Sales!" and pass out suckers. My dad did this about 10 years ago. Worked like a Charm. <--- get it?!

    The dealership, used or new, cannot sell a vehicle in an unsafe condition. The frame being as rusted as it is is unsafe. The dealer has to take the truck back and refund your money. They are legally held liable for the vehicles they sell, warranty or not. Sold as is or not. This rust has obviously not happened in the past month. If they give you a hard time, then lawyer up. Do not threaten with a lawyer as this will only make things worse in dealing with them since they are obviously not a reputable dealership. Get a lawyer to write up a letter to the dealership and go from there.

    I had a friend that had this same situation happen to him. Thankfully, the dealership worked with him and gave him all of his money back. They even bent over backwards to make sure he was happy, even put him in a better truck at a very good price. But this was a new car dealership that had taken trades. So hopefully you can get this same outcome.

    Starting with the dealer then Toyota if that frame can't be resolved definitely take on litigation. That's screwed.

    Check into your local laws, call an attorney for a quick "yes/no" if you have to...some states have laws against selling vehicles that can't be properly registered without passing a safety/emissions test. Unfortunately though, some states don't.

    Agreed. Threatening them with a lawyer while you're on site will get you nowhere. If they don't want to fix the problem, then go find a lawyer and have him/her surprise them with a nice letter.

    A dealer can sell whatever they want. The uniform commercial code basically offers next to nothing for protections. So unless the OP lives in a state that requires a safety inspection before registration he's boned.

    Unfortunately, that's not always true depending on the state. A quick internet search on the issue makes it sound like it's a gray area in most places, and that a lawsuit is recommended if the dealer won't offer to fix the issue or take the vehicle back. A lawsuit would probably eventually get them to work with you or take it back, but that's a costly headache in and of itself.

    wow, this is really bad. How can they sell something this compromised? It also has already been patched all over....

    Take it back and if they don't want to deal with you, get a lawyer. This dealer is either blind or is an idiot for selling you that

    Anyway, depending on how bad and where the rust is, it is possible to fix the frame, but I would first take it back ASAP and try to get my money back because this is unnacceptable

    If Mississippi hadn't recently done away with vehicle safety inspections he'd have them over a barrel, since they had stickered an unsafe vehicle. But now that they don't require inspection stickers any more, it will probably be a lot more work for the OP to get them to fix it.

    Oh there will be some mods all right
    I've heard that an unsafe vehicle cannot be sold from a dealership even if it says as is and the only acception is if they specifically list the unsafe issue with said vehicle.
