    with no lease, he has no rights whatsoever. you can tell him to get out, now. but a court may frown on that. give him at least 24 hours. if he wants to get bowed up about it, call the sheriff. they'll probably tell you they don't do guard duty, but at least a record of your concern will be made.

    put it in writing. he doesn't have to sign it, and if he tears it up it's proof he saw it.

    anything he leaves behind after his time is over belongs to you. i'd be nice and give it to him later though. just to help smooth things and possibly prevent retaliation later.

    cruel, but the law. i've had to use it before on "friends". had to take one to court to make him pay for the damages he did while there (and moving out). told him there's no shame in paying in what you owe, but a person would look pretty small in court trying to weasel out of it. he paid before the court date.

    thats what i'm worried about more. When time comes for him to be gone, since he didn't sign a lease, i don't have as much leaverage and he won't take me seriously.

    That only means you won't be able to force him to pay. You can most definately legally make him leave.

    when the first of the month comes around and if he does not pay, give him written notice that he has __ days to move out. Change the locks if you are worried about your stuff. If you don't have class on Friday, try giving him the notice on Thursday after class so that you have the weekend to make sure nothing grows legs.
    You may also want to check on state laws concerning eviction. I have herd some messed up stuff happen when a lease was not signed. If he is paying rent then he is a tenent and could have the same rights.
    Cover your ass.

    Hey man the only way you can have the law behind you is to have him served with an eviction notice. Any other way and he can just sit there on the couch and not move an inch. I have seen several people go through this and even it still isn't pretty.

    Dude, when I first went to college two years ago, I lived with two friends from HS. DIDNT work out at all! Its hard living with them, I know how you feel. Live with people I met here at FSU and its so much easier.

    i was there once before i moved to SD. My (still) good friend just wouldn't pay up.. and it used to be just late Late LATE payments cause he was a slacker and all.. but then it turned to no payments.. and i know i'm repeating what everyone else has been saying; but i literally just said "dood, lets talk" and told him that from a business standpoint, i cant do it. Simple rule of life: pay or you're out. And he was cool with it. Of course i put all that nicely and explained myself throughly and shit...

    I mean, any true real friend like my buddy will understand that and not wanna stiff you with all the rent. He ended up living in the den for a bit when i moved another buddy into his room till he got up off his feet and moved into his own spot. Even with that i laid out ground rules (eg: You got ONE month homie - then you're out OUT).

    BASICALLY - just like everyone has said, just talk to your buddy - he'll totally understand,

    I'd check with a lawyer to see what your rights are and what his are. It might cost a few bucks, but if you find out exactly what you can and cannot do, might save some heartache later on.

    It's not gonna be easy, but don't back down. Do what you have to. Good luck.

    Landlord/Tenant Laws vary by state, so check with the Constable or visit a law library, that way it is free. Or if you have the extra $$ and not the extra time check with an attorney.
    I know here the law is not based on a lease or contract, but if someone has 'established residency' meaning they have property there, have bills in the name or get mail at that address then they live there and have full rights to the property and have to be evicted by a Constable. Also cops can not assist (except to provide info) unless a crime is committed due to Tenant issues being civil not criminal.
    Just something you might want to read up on for the future. That is why I'm hesitant to buy a house as a rental, too many issues.

    Google 'Alabama landlord tenant laws' and do some reading, but if it doesn't make sense to you then contact a Constable or an Attorney for the best information, laws can be confusing to interpret.
