I know in WA if she wants 50% that’s automatic, I think he would have to agree to the other 50%. This makes me incredibly angry though. I hope this is wasn’t a serious question and someone was trying to stir shit up. I know military spouses serve too but how low to “fall apart” while he was deployed, get pregnant and still seek 100% I’m really hoping this isn’t a true story. Rant over

Yeah same here, 50% is standard unless the spouse waves it. I understand they put time in too but a lot of the time being a military spouse isn’t that different from a non mil spouse until their service member is deployed or TDY for some reason. Maybe pro-rate it for the times the member was away from duty station ha

Buddy of mine did another option: He got off active duty and went in the National Guard. In the Guard you do NOT get your retirement check until age 60. LOL. He was like 35 when he planned this mission. He's still in the Guard, and she will not be able to touch it for 15-plus years. Think outside the box guys.

 

In California, the marriage/divorce/family laws are very heavily weighted toward the woman. The woman automatically gets 50%, unless she agrees to less, and the Judge approves such an agreement. She can certainly request >50%, but the Judge would take such a request under advisement, not just automatically grant such a request.

This is the case even if the marriage lasted 24 hours - unless it were to be annulled. Also, for Spousal support ("alimony"), the default is the wife will receive support for 1/2 the length of the marriage if the marriage lasted <10 years. If it laster >10 years..... she is entitled to support for the remainder of her life, unless 1) she re-marries, or 2) you die. And if there are children <18 years of age, 99% of the time, the woman will get full, or close to full custody, and the man gets stuck with child support, and occasional visitation.

I've been through 2 divorces in CA, 1998 and 2018. Neither marriage lasted even close to 10 years (thank God), and no children either time, so I escaped somewhat lightly in both cases.

I would agree, that is indeed rot at the very highest level. Fucking disgusting. Pisses me off that people like this are able to get into very senior positions, and otherwise good people, who don't have "friends in high places" may never get the chance to advance to their own level of merit. And I mean in any field, not just the military, or government.
