Chill. You will prevail. This is typical. Delay, delay, delay, delay....they WANT to put pressure on you to just give up and settle (e.g. "pay them something"). He hired the attorney probably because someone told him he was going to get his ass chewed out by the judge. But sadly, "as is where is" doesn't have the same literal meaning in the courtroom that we would like it to have. Banks are held to higher standards. But as a private individual you should be fine. I would countersue - I am sure you can find a reason as ridiculous as his.
