    Sorry to hear it got it got postponed.

    You might want to have your lawyer pull up this guys driving history, hopefully it shows some sort of reckless driving which shows history of him abusing vehicles

    Just follow the sob - not too close so he can't get you for harrassement - and video/take pictures of what he does with the truck. Show him abusing it, and the judge should rule your way. That way you can counter that any damage was caused by him and the way he used the truck.

    Wonder if the SOB... forgot what his name was supposed to be, has read this thread to know what you are saying and going to do :eek:

    Even if you didn't sell it "As Is" and even if Asshat didn't beat the hell out of the truck, there is no reason for him to sue. You did nothing wrong. This shouldn't even be a case. He bought the truck at his own risk knowing that he can't return it, and knowing that it has no warranty. This guy is a retard! Sorry that you have to put up with him. I'm looking forward for an update in April. If this guy wins then im Taylor Swift!:rolleyes:

    Betting his lawyer put him up to this thinking the insurance company will want to settle and not spend more time and money in court. Old trick for a fast buck.

    Talk to a lawyer of you own (not from the family biz) and see about getting this kicked. Then ask about a counter-suit to recover your costs and damages. Who knows - might make the whole thing blow over if this kid's lawyer has any common sense.

    Is he still driving the truck? If he is, this may be his undoing. If he is claiming the trauck was defective, yada, yada, yada, then why does he continue to drive it? This will be very telling for the judge. In effect, you can't claim you have been damaged but then carry on as usual. You must make some effort to reduce or minimise the damage, which from what I reading, he (the scumbucket) is not.

    Just a word of caution here, remember this is an open forum so just use a little common sense when talking about the case or your strategy, you don't want anything being used against you later.

    Of course that doesn't mean the rest of us can't talk about the guy needs to be hanged from his scrotum sack and given a pepper spray enema :rolleyes:

    He has no chance to win unless you put in writing that the truck was in perfect condition and will never have a problem.... He bought it as is...


    was the truck registered to your company? Did you sell it to him with your company name on the title? Is your business a dealership? Even if you sold it under your business name if you are not a dealership you do not go by the same consumer laws. Business's sell property and items all of the time. Most of it is junk but it is all as is. This guy is probably being told by someone and maybe even his attorney that if they scare you enough you would just settle out of court. Just don't fall for it.

    Also, make sure that you take with you any paperwork to show proof of any mechanical work done to vehicle, even if it is just receipts for parts, oil anything, (unless you gave him all the paperwork) in which you would tell the judge, or show credit card statements, or a letter from your mechanic. Make sure you stress that you drove this vehicle daily and never had the problems this person is claiming. On top of that stress that you have no knowledge of how the purchaser treated the vehicle, (unless you have proof of the doughnuts in parking lot) and so you feel any issues with the vehicle are related to the purchasers treatment of the vehicle.

    Don't forget he is taking you to court which means he has to prove beyond a reason of doubt that you purposely sold him a vehicle fraudulantly... He can't prove that. If he says the alignment is off for instance, your argument should be, how do you know he didn't go speeding and hop over a curb which could throw that off. or If he says it is leaking oil, how do you know he didn't run over something that busted the oil pan?

    He test drove it numerous times even taking it to his mechanic, he made the conscience choice to purchase the vehicle after he tested it out. Make sure you also point this out as well. In general, private auto sales are on an "as is" basis, and are not covered under so-called Lemon Laws.
