    if the judge doesn't make that ruling in court then i would definitely file a counter suit. this little prick is wasting your time and money over a load of bullshit, it's not fair for you to have to pick up the bill for his stupidity. talk to your lawyer about it, he'll know what to do. in fact, that means more money for him so he'll be happy to do it.
