That won't happen...she was obviously alright and walked away fine. I don't see how they could say the mall was negligent.

Lol, what aid was there to give? She fell on her own account, then got up under her own power.

The only person who could/should get in trouble is the person who posted/recorded the video. Aside from that, I see little room for any claim

....The video shows the maintenance worker talking to her shortly after. he went to her aid....Like hey....You need a towel? What the hell kinda of aid does she want. I think the mall should get her for trespassing.

She should not be swimming in a public place. The video clearly shows she dove right in.

 

if a kid would have jumped or fell in the kid and the parent probably would have gotten throwed out of the mall.

"In the hours that followed Cathy Cruz Marrero's appearance on 'Good Morning America' today to talk about the fall and its aftermath, she was in court for a status hearing on charges of five felony counts, including theft by deception and receiving stolen property," reports ABC News.
Turns out Marrero's been out on $7,500 bail since 2009, after being charged with running up more than $5,000 in purchases on a co-worker's credit card. No wonder she had a lawyer handy.
Marrero's next court date is April 21, and she's facing about six months of house arrest and electronic monitoring, according to the Reading Eagle. So all y'all talking about how if she just shut up and went on with her life, nobody would know it was her in the fountain —maybe six people recognized her — are more right than you realized. While it's unknown how many people knew about her theft charges, we all sure know about it now.

 

I Total agree, can no one take personal responsibility for anything anymore?

 

I have some pity for the woman - to be dumb enough to rack charges up on her co-workers card, get caught for it, evade any meaningful trouble, then fall in a fountain and dare speak up about it. I guess she is hoping somehow she wins a lawsuit and gets some money. I'm sure she'll try to sue someone with insurance so they can just settle out of court quickly. In which case, her own negligence will make her $.

I love rewarding failure and punishing success, don't you?

EPIC FAIL!!! Ok, it was a harmless fall and this time the only one she hurt was herself. If she walks and texts then she is definatley texting while driving as well. My buddy was just hit last year on his mountain bike and injured pretty bad because some girl was texting while driving. She literally drove up on the sidewalk and mowed his ass down.

We make examples out of drunk drivers, IMHO this is the same.

 

Actually california is passing a law to make texting while driving just as serious as drunk driving. so you will be taken away in a squad car and have to pay ridiculous ammounts of money to even think about getting your license back. and wait at the DMV im sure more than once (worst part IMO)
