    In California, the laws that criminalize driving under the influence are not limited to highways or public streets. You can indeed be arrested for driving under the influence while on private property. However, the arresting officer is going to need to be able to articulate why he or she had a reasonable suspicion to stop you in the first place or else it is a violation of the 4th Amendment and all evidence obtained from the stop is inadmissible (fruit of the poisonous tree) at trial.

    Whether or not you decide to speak to the police is a personal decision, but I would be weary of answering questions from a trained investigator without the assistance of counsel. The US Constitution gives us some very powerful rights. Why not use all of them?

    Luckily I don't do stupid shit to warrant having to worry about talking to cops.

    Oh by the way. I've been in law enforcement for almost 14 years. I'm not a street cop but I work with them every day. Your advice actually holds water if you've actually done something wrong. If you don't have anything to hide talking to the cops is probably a good idea. If you pull the old silent treatment they will most likely dig further or take up more of your time getting to the bottom of the issue.

    Most cops give what they get. Granted there are those assholes out there who have a massive power boner.

To add to the fire, since it was a gated private community I don't think the 5-0 can even enter the premises without a reason to. If nobody called the cops on me, I don't think there's any reason a cop could even be close enough to see what I was doing or in what condition I was in while doing so.

    It has nothing do do with private property, but property open to the public.
    Example: I am riding a dirt bike at the dunes which is open to the public, I am liable to a DUI even if it is not a roadway. Same as in the woods on private property owned by a logging company if the gate is open. Now close that gate, and give me permission to ride there it changes. Just like riding/ driving on my own personal land as long as I don't cross a public right of way. So, "open to the public" is what matters, at least in the state of Oregon.
