OP, I'm sorry for your loss. it's ashamed that we can't trust (a few) fellow TW members on here. Hopefully he gets the Perma-Banhammer for being a POS scumbag!

flame me if I'm wrong but...

it doesn't look like OP ever verified the condition of the flaps before purchasing.... or at least doesn't mention what condition they were described as before the sale

Did you see photos? What was the listing like? Did he straight out lie about the cracks, or was it assumed?

Not trying to be a dick, but I've sold plenty of things online without the buyer being too concerned about the condition until after the sale...

he sent me pics to my phone, said in good condition, I did not SPECIFICALLY ask about the cracks, it could have been my ignorance prior to the purchase, but the quote in the first was straight from a pm, he agreed to refund me $10 and now I can't get a hold of him, it's moreso the principle of dishonesty, not that fact that I got broken flaps and am now offering them for free, and willing to pay for shipping.

whether the buyer asked about the condition prior to the sale is irrelevant. What he got sold was unfit for use. Would you sell an item without listing major defects ? Point is the buyer was misled by a dishonest seller. Most people see fellow TW members as trustworthy, most people never get burnt.

Why is it irrelevant? Would you purchase a used item sight unseen and just take someones word on the condition? Hell no, especially online.

Unfit for use? They are a cracked but repairable, not "unfit for use". This isn't safety equipment like brakes or seatbelts. It's a mud flap. Plenty of people buy used items and repair the damage to save money

I don't sell defected items, and if they are I clearly document it to cover my ass in situations like these.

unless we see the original posting, or get some verification of the communication OP had with the seller before the sale, you can't claim he was misled.

Most people, true. But blindly trusting someone is always your own fault, no matter how other people paint their picture. Especially when its a fairly new member with most posts in the FS section.

nosoup4u, i'm not sure the point you're trying to make,

the seller agreed to give me a partial refund, and won't return messages, and it shows he has logged on throughout the time he has not responded, since 8/10/12, that is all, doesn't matter what he was selling or how it came. he could have denied it, or not agreed to anything, but he did

saw this after my last post .. but will leave it up just because.

with pics sent and saying good condition, I would agree that you were misled

However, most people ask the specific question about cracking and want detailed photos before purchasing for the very reason that it's super common on our trucks. Can't tell you how much hassle I went through taking photos and guaranteeing condition before I got mine sold.

As for the whole refund thing, I wouldn't count on a PM. He obviously wanted to get the sale without much info on the condition so it's likely he is not being honest still

Sounds like the Mods need to add a clause in the BST rules about sellers listing item condition in description. I've sold and bought plenty here and on eBay.
