I dealt with something similar on a topper I had. I filled with with silicon then plastidipped a small square on top of it.

I am definitely not a lawyer but I believe this does not fall under undisclosed damage. It's an antenna hole, intentionally placed in plain view and (admittedly poorly) repaired.

It's not your responsibility as a used car seller (even dealers) to highlight every single flaw. You have to be honest if a shopper asks a question and having a taped over hole on the roof falls under (no offense @pca501212, we have all made similar oversights) something you probably should see during an inspection and ask about.

Even if it does fall under undisclosed damage to make it a big deal would cheapen actual undisclosed damage like being in a flood, salvage titled or something like that. If anything legally the dealer/seller may have to reimburse the guy $1 for a proper plug.

A used car sale is generally as-is but there is a stipulation that after the fact if something is found that should have been disclosed the seller *may* be legally required to reimburse you. But that's like the engine blows 100 miles later because they didn't tell you they dumped in two bottles of Motor Medic and 3 quarts of 20W50 to quiet an obvious rod knock.

It's definitely an unusual application of disclosure law, and though I'm not a lawyer either, Id be surprised if there's established precedent on it.

Intentionally modified or no, I would consider a vehicle with a hole in the roof as damaged. Plain view is arguable depending on if you're 6'5" or not. It would be a fun conversation with the dealer for sure. If it were mine, id at least ask them to split the cost of repair, which will be far cheaper that what they will incur defending in small claims court.

Surprised nobody mentioned this already, but just plug it up with a rubber grommet, and some silicone, and call it a day.

Yeah, I dunno. As far as plain view I personally look on the roof to make sure it's not hail damaged, dented, rusty or the paint oxidized off. Doing that it wasn't like the seller tried to hide anything. But even if you personally don't look at it doing due diligence by having a mechanic inspect it would I hope mean someone "qualified" or "expert" would look.

But it would ultimately come down to each person's view of what is damage vs modification. A hole in the roof to a ham (like me) is normal use but to another its damage. Someone else would see a bug deflector screwed the hood as normal modification while another would see 6 screw holes under the hood as damage.

That's why in the case of a used car it's what you see is what you get. Undisclosed is for stuff you reasonably wouldn't expect or should have been told.

So it's a matter of what is reasonable, I get that. Most people aren't hams so you could very well be right that if I modify my vehicle like that I should tell a potential buyer. I mean when you buy a retired cop car or old Forest Service or fire truck you would expect it to once have had antennas and plugged holes shouldn't be a shock. I would just plug the holes and call it "repaired" personally and being minor I'd treat it like rock chips and shopping cart dings, just normal stuff that I wouldn't feel compelled to point out every single one.

You don't have to tell someone you smoke, the buyer has to think to ask that. Or if you go 4 wheeling. If I'm buying a 4wd truck I ask or look to see that. I know I'm going to beat the snot out of my truck but I'm shocked, shocked I tell ya, that someone selling a 4wd would have gone anywhere but to church only on Sunday mornings when it wasn't snowing.

If your not going to get it repaired correctly, the get a HAM and get a good antenna that will cover the hole and seal it correctly.
HAMs are great to have when traveling in a group, we used them going up to the Arctic Ocean and it was like being next to each other. Our range on 25 Watts was about 30 miles
