So, you expect the father to just hand you $500 and say, "Sorry about your truck. We're all good now, right?"

Ask your professor what he/she thinks about that. LOL

Sure, if you have a legal team for free, then there's a bit of difference in options, since you'll have plenty of shady but "legal" avenues.

But for average Joe who just got into a fender bender, you report a crash that involved a 20+mph impact when it happens and go from there.

American law knows no ethics or morals. Lawyers become politicians, nothing more needs to be said.

*yawn Yeah actually I do because it's in his best interest and he seemed more than willing to shell out cash asap. Ask your common sense about making assumptions on a situation you have no details about before you speak on it.

If you asked me for 500 after this same accident , I’d say sure I’ll give you 500 but you have to release me of any and all liability and I’m sure you’d say no. If you take 500 in your pocket and then go after the insurance instead of just filing a claim and the father basically pays twice once to you and then his insurance that’s truly a show of character. Come on man don’t be that guy who’s a dick. Just file a claim, have the frame checked and get your money from the insurance get your new bumper or not and know your frame is good.

No simply put I'm giving him an option. You're just being careful about vs. him just wanting to be done with it. I never said I would do that but I pointed out that documenting the payment has no benefit to me so why bother. If he asks for it I can write something up but this situation has already taken enough of my time for a kid on his fucking phone while driving.

Reminds me of this dealership I went to the other day had a vehicle that looked rust free, but I ran the carfax and knew it might being from the Midwest. I got closer, saw and pointed out the shoddy black spray paint job on the entire suspension. Sales guy said "I've seen worse." Uhh byeeeee :burnrubber:

This ^ you never ever take cash from an at fault person for damages, insurance would of given 3 times more than the dudes father did,and that's IF there is no other unseen damage.

No the father will tell you to get lost, and say its a done deal. You take the money (that's a contract) then later try and get more ,that's fraud.

You know the mods are watching, with their finger nervously twitching over the ban button.

That's the only reason I haven't posted a bunch of lawyer jokes.

Got the frame inspected again and came back clean, taking the cash and calling it done. All of you jumping to conclusions about me shooting myself in the foot or committing fraud are insane. Meeting with dad in a couple hours to get payment. Yall are crazy.

I used the fact that there's no written contract as an example of why that would only benefit me if I were to commit fraud. You decided to jump on the band wagon of immediately assuming I was going to when I was trying to help a guy not have his insurance go up as he requested

No, a recorded amount of money being transferred with intention is a contract.
