    You don’t read too well/carefully…

    In any case (IN or NC) ‘negligence’ may be determined by the court. In all cases, the ‘liability’ is the tree owners. Now does that mean he pays, not necessarily. The extent of the tree owners negligence and liability is undetermined in this case, but if there was one dickhead on the street who had the manky old cottonwood, right next to the curb, that squashed my shiny new truck, because he knew it was a hazard and didn’t take care of it ‘I’ would want to find out before ‘I’ put it on my insurance.

    Has the town been sending him letters about removing/pruning his tree for years..?

    Has a certified arborist told him it was diseased..?

    Has his homeowners warned him..?

    What if there was a child in the car…?

    Look at the tree across the street (most limbs over the sidewalk/street have been removed)

    Look down the street (not many folks still have a giant widowmaker in the front yard)

    Look, you wanna pay, put the claim on your insurance, have your rates adjusted, suck on it ‘cause some jackass wants an unreasonable tree in the public area of his property, again…


    go right ahead.


    (ETA: to thread jacking; the title of the thread asks “how long..” stupid or naive is usually quick and easy, correct or responsible often takes a little more time.)

    I agree with you that there *could* be instances where the homeowner is liable. But that still requires proof and ultimately my time is more valuable than chasing that possibility. All I'm out is a small deductible and my rates will not be adjusted due to it being an "Act of God".

    It's pathetic that people are still bitching about liability of a tree falling. If his insurance company feels the need to subjugate the claim, i'm sure they will. I'm sure the OP just wants his truck fixed and gives zero fucks

    Update: the new roof panel came in on 8/25. Body shop estimated 2-3 weeks to make the repair.

    I found out on Friday, 9/10, that the shop had submitted a supplemental repair adjustment to State Farm on 8/27 and still hadn't heard back. I called State Farm that day and they said they would respond today. They still haven't and now SF says they'll get back to shop on Friday... So I'm still looking at a few weeks
