Turn the claim over to your insurance company and don't worry about it. If you've changed insurance since then - make sure you give it to the company that insured the car at the time of the original accident.

They have lawyers for shit like this.

Other folks have given you advice about looking up the guy, filming him, etc... DO NOT DO any of this, as it could be considered trying to intimidate someone who has filed a claim against you - and could actually get you in CRIMINAL legal trouble.

Let the insurance company's shark lawyers handle it and sleep soundly.

It's lawyers who are at fault here. The guy probably was low on cash and saw one of those ambulance chaser ads that play on noon-time TV. Lawyers love those fat insurance checks as they can take half the money for themselves.

I've been run into several times and never even considered filing an injury claim. Heck, I've been injured several times while working EMS and just patched myself up and called it a day. However, I seem to be the exception -- the insurance commissioner himself in my state filed a hundred thousand dollar workman's comp claim because he "injured" himself on the job... lifting his tiny briefcase out of his car's trunk.

I was taught by an attorney friend years ago to ALWAYS ask for a parametic at an accident no matter what the damage was because it protects you from made up injuries.

 

Wow, sounds like you American guys have some really affordable insurance providers. Here in BC we have a claim based scale for our insurance.. every year without an at fault claim earns you a bit of a discount up to a maximum. Having never had an at fault accident I have the max discount on my insurance and it still costs me $1950/yr.

They use driver record (ticket history) to determine penalties on your drivers license. Lots of tickets -> massive surcharges on drivers license fees, that way you gotta pay for dangerous driving habits whether you own a car or not - so long as you want to continue having a drivers license anyway. I pay another $700/yr in these penalties.

 

Damn. Canada has it rough.

 

I just point my truck further down the road instead of into other vehicles or obstacles. Seems to be working pretty well so far.
