    i just got this email, i filed a claim back in i think 2008 or 2009 for the intermittent burst of acceleration which still happens, also later for the spiral cable (which they have now replaced twice) and a few months ago for the 'GAP' fraud. the acceleration thing they did the pedal mod and the cables they replaced twice, check your original NEW purchase invoice (meaning you bought it new from toyota dealer) , if it has a charge for 'GAP' coverage PLEASE FILE A COMPLAINT! below is the response i got when i file the 'GAP' complaint. i did not fully understand what GAP was until after i got 2 insurance adjuster license and and insurance producer license. if you called your agent and switched your old vehicle coverage to your new tacoma and they were aware and forced you to buy GAP coverage that is known as insurance fraud and toyota is ducking it like the plague! when i went back and read the fine print it said i was not required to pay the $595, i mean the really really really small print, but the salesman said i had to. anyway the point is, if you bought new and paid for GAP coverage, call toyota and make a big deal of it! the other point is, this response i got may help others in other problems they may have.

    We have updated your address in our records as requested in you previous email. As explained before, please note that on July 24, 2013 the Court approved an amended distribution plan which allows for payments to certain class members who did not file claims on a pro rata basis depending on the amount of money left in the fund after payment to the timely filed claims. We are currently finalizing the distribution of settlement class benefits to class members that filed timely claims. Thereafter, funds will be distributed to eligible non-claimants in accordance with the Settlement Agreement.

    You are also eligible for the Customer Support Program, which did not required you to file a claim: Since the Court has finally approved the settlement, for Class Members who still possess their Subject Vehicles, Toyota is implementing a Customer Support Program that will stand by the reliability of the vehicles by providing provide prospective coverage for repairs and adjustments needed to correct defects in materials or workmanship in certain parts associated with the vehicle’s operation at no cost to the owner or lessee if any of those parts fail, break, or malfunction. The Customer Support Program will last for ten (10) years after the expiration of any existing warranty for each of the covered parts, subject to a maximum limit of 150,000 miles, except that each eligible vehicle will receive no less than three (3) years of coverage from the date of final settlement approval (regardless of when the underlying warranty expires and your vehicle’s mileage), if the Court finally approves the settlement. The covered parts are the: (i) engine control module; (ii) cruise control switch; (iii) accelerator pedal assembly; (iv) stop lamp switch; and (v) throttle body assembly. The Customer Support Program is transferable with the Subject Vehicle. Inoperable vehicles and vehicles with a salvaged, rebuilt or flood-damaged title are not eligible for the Customer Support Program.

    If you are a Class Member who is eligible for the Customer Support Program, you did not need to take any action in order to be eligible to participate in the Customer Support Program. If a covered part fails, breaks, or malfunctions due to a defect in materials or workmanship from the date of final approval through the end of the Customer Service Program, you should take your vehicle to a Toyota/Lexus/Scion authorized dealer for repair or adjustment under the Customer Support Program.

    I do see your point that the dealers should explain GAP insurance to each and every customer.

    I wanted GAP insurance, I paid 31,500 for my taco and owed so much on my previous truck, so on paper it shows that I paid 34K to pay off my previous trucks balance on the trade in.

    The gap insurance will in my case will cover the balance of the loan over the book value in case of theft, total loss Etc.

    I appreciate your coming forth with this information OP, but I do ask something. USUALLY, part of filing or accepting a class action or settlement, is that you agree not to talk about the details, or discuss the case with anyone else. Double check your paperwork. Talking about a class action/settlement case that is still active may be a big mistake.
