Is my truck totalled?

    I was pulling out of a parking spot super slowly as I always do, and this lady going at least 30 nailed my front end and dragged my car out of the spot and into the car parked next to me. I was no more than 2-3 feet out of the spot and the lady dragged my truck all the way out of the spot, that’s how fast she was going. All the damage is in the front, wheel well, and the passenger door will most likely need to be replaced. The truck is an 07 ac w a little under 200k miles. She’s in good condition and has never had a problem. Aside from the value of my mods, will insurance, in your guys’ opinion, consider the truck totalled? Also, will insurance take into account my mods for value it it is not totalled (for instance my pro grill)?

    Totalled is a term that varies I think by state, it goes by how much it takes to repair vs the value of the vehicle by a percentage I think in new Mexico is like 85-90%

    Edit: my old mercury the bumper got dragged off by parking divider and it was to cost about 900$ to repair but even though the car is in perfect condition it came to be enough to be called totaled

    Unfortunately, I bet that they total your truck. They will not give you anything for the mods, been there and done that.

    They will figure a value for your truck before the wreck, and subtract the salvage value. If the repairs are larger than about 75% of the difference, you can bet they will probably total it.

    example- (Not saying the values are correct)

    Truck- 8k
    Salvage value- 2k
    75% of 6k= $4500

    If your damage is over $4500 they would total it. At least that is the way my insurance agent explained it a few years ago when my car was totaled.

    Try to go back to those businesses and pull video of the accident if the business will give it to you (gotta ask really nice). If you can prove she was driving recklessly that will help your insurance company fight it. Otherwise they may do a 75/25 or 50/50 fault. Unfortunately most businesses ask for a subpoena anymore for video.

    Considering I didn’t even see her car until after I was sideways, I would say it was her fault. However, I’m not sure if insurance will report it that way. Thank you for the idea of checking to see if there is video footage, that’s a great idea I didn’t think of! There were multiple witness reports, one being the frickin turd gen turd off road. Nobody was hurt and it doesn’t look like there was frame damage to mine. She still drove fine so it’s all cosmetic. The passenger door doesn’t open from the outside and it’s dented and scratched so it would cost more to fix it and paint it rather than to just replace it.

    When my insurance company refused to compensate me for all the mods I did on my totaled T-Bird I just took them all off and resold them. Including brand new Gatorback tires and nice rims; got junkyard replacements.

    Unless you can get video to prove differently, the photos you posted looks like you pulled out in front of her. I'm not saying you did though. Do you always park backwards in a parking lot?
    If your truck is totaled because it's old, buy it back. It does look like a fairly easy fix.

    Can't tell from the pics but are the gaps at the bed and cab even on both sides? Damage doesn't really look that bad on either vehicle for a 30mph collision.

    Could go either way, but my guess is that they will fix it. At least here in GA. It comes down to the cost to repair vs the trucks value. I have a similar 07 DC with just over 200K. KBB says mine would sell for about $12-$16K on a dealers lot which is what they will have to pay you if it is totaled. I don't think it'll take anywhere near that to repair your truck.

    If this had been on a highway you're at fault. The other car has the right of way when you're pulling out. But speed can be a factor and they might charge both of you. But It appears that it happened in a parking lot on private property. Most likely no charges will be filed and your insurance company will cover you, the other driver will be covered by their insurance. At least that is my guess. Not sure about the 3rd vehicle, but your insurance may be paying for it too.

    Insurance companies handle fault completely independent of police determinations of fault. They also share fault. So in this case they would assign fault to you at a percentage for pulling into her path and she would get a percentage for her speed. If you were 60% and she was 40% and your repair cost $1000 then your insurance would pay $600.

    Looks repairable - door, bumper shell, plastic fenderwell liner, 1 headlight, 1 fog light. Insurance probably won't total it.

    The pro-look grille might not be damaged.

    Most collision shops will elect to replace a door with this type of damage due to the side-impact guard beams inside.

    I filed the claim with my insurance and it’s a $500 deductible and they pay the rest no matter who is at fault. They said most likely it will be partial but I have pictures to show that she was going fast. Look at the length of her skid marks, that doesn’t happen going parking lot speed. The wide skid mark is from my truck moving sideways and the one above is from her car. I’m just hoping the insurance company sees that and understands it.

    Still waiting on insurance to decide on who’s liable for the the accident. However, I got an estimate and it’s $3200 - $500 deductible. So, not totalled! I definitely want to go with an off road bumper so I was wondering on your guys’ opinions on some decent ones. It’s a 2wd daily driver so no need for anything too over-the-top. It’s mainly for looks but it will also get used when I have time to go on trials.
