I've never thought about it from the burden being different between a company and an individual. I've bought and sold probably 500+ items (I've been around s2ki, lotustalk, 6speedonline, etc) for a long time. If I've ever sold something and it not arrived as expected, I deal with the issue. Perhaps I've been too helpful, I just assumed that was the way the world worked or I treated people the way I wanted to be treated. I'm not hurting for $515 dollars to be returned to me today. I'm more concerned with how long the process of the claim will take place and what happens if UPS determines they are not at fault or willing to return the insurance cost.

All shipped items should be packaged in a way to handle the worst delivery guy -
Sorry your lights arrived damaged OP, doesn't appear as though the seller intended for the lights to arrive as they did. I'm sure you guys will get it sorted out. It was probably one of these A-holes delivering the them.

@Ro_Ja Boy I agree with you that idealy you should be made whole quickly. When I am selling I do all I can to be the guy I would want to deal with ship promptly, package to prevent any damage, be polite and courteous, and IF any failing happens I step up as well.

On the other side of the coin, I never expect or ssume (though I do hope) that others will do the same for me should an issue arrise.

I was raised, and I am gussing you were as well, to do everything I can to treat everyone else better than I expect to be treated and at least as well as I would like to be treated. Best of luck gettign a prompt and satifactory solution.

I don't think anyone believes it was intentional; however, the difference between being perceived as a dishonest seller vs. an honest seller is how one resolves issues. The fact that this has gone public means the issue hasn't been resolved. Many of us have sold and bought in this forum, and it's in everyone's best interest to resolve issues (and preferably behind closed doors).

I hear ya. I'm not blaming the seller in terms of...it's possible it was well packaged and the shipper didn't treat it well/it got stacked underneath things/etc. It's not always in our control, but Kustom 54 said that they felt it arrived without enough padding on the brackets which we had specifically discussed the importance of. I hope UPS takes fault...I just don't know why I should be expected to wait and see what happens when I literally could have done nothing differently. I actually paid him to ship to me and then had them shipped to Kustom 54 which is much closer to the seller than I am.

Small world for sure. I bought my first s2000 in 2003 and have had four in total...3 of which have been at SEMA (I used to work for the SEMA Show) and 2 in multiple magazines. My point being that I've bought and sold TONS of parts for that and every other car I've modified (Titan, STi, M3's, Lotus, Z06, etc). It's not my first rodeo and it won't be my last. :)

    That packing is horrid.

No shipping company will accept a claim on that, clearly its the shippers fault for extremely poor packaging -- The size of the box they were shipped in was big enough for ONE properly packed headlight.

Seller should reimburse the buyer in FULL. If he wants his now useless headlights back, he should send a return label....just own your mistake and move on with life RON!

To be fair...since it got shipped to Kustom 54 and not myself...for all I know much of the packing could have been removed in those photos. The photos weren't intended to show me how they were packed...just the damage of the headlights.

I'm just saying if you need microfiber rags to keep them from banging together, you did not use enough bubble wrap. LOL.

Agreed that this responsibility falls on the seller. I'd either have them shipped back to them at their cost (which you offered to do) or if he still refuses file a claim and let PayPal and the seller deal with it.

I would agree on very subpar packing... if that photo shows how they were packed that would definitely be my reasoning. Should be individually wrapped in bubble wrap surrounded by paper or something else to take up any other space for them to move around in the package. Where I work if something gets damaged we always refund first then work out a claim with the shipping company, and I personally would do the same.

To me this is a PRIVATE matter. Calling someone out in public is a douche move IMO when you haven’t even allowed them reasonable time to sort it with the courier company.

My hope with this thread was just to get the perspectives of others so that the seller or I could realize whether our positions were the majority or minority thinking. Hopefully it helps him to see what he should do, but I've filed a claim with Paypal and will file a claim with my CC if need be.

Again, my intent was to see whether I was looking at it incorrectly or he was. He posted a few mins before I posted this thread on his for sale post about his intentions and he and I had already texted back and forth. He was clear he wanted to wait to return my money until after he resolved it with the courier and as most people have said, that shouldn't be the process.

makes sense, but still buyer shouldn't have to wait on UPS to decide , seller should refund ask for product back and then go after the carrier

Anyone with a brain is going to agree that any courier is not going to accept this claim -- you have to provide pictures and sometimes the actual box, packing material and damaged goods for investigation. Literally takes 2.5 seconds to refund an invoice on paypal and create a return label.
