My point was what the thread was intended for, to get a consensus whether I was right or wrong for expecting him to return the money and then deal with the claim. We've gotten general consensus and am happy to update everyone once it's resolved so that they can make a determination whether they like how things would be handled working with me as a buyer or the seller as a seller.

If he refunds you money, and your claim settles, then you get double whatever you paid for them via double refunds - and he gets no money, no headlights.

Again.. not sure you know it works, and what you’re asking him to do is unreasonable for the reasons in my first sentence.

I would close the PayPal claim at that point. I understand how things work. I've bought plenty of things online.

He should refund. If box is not busted and items are broken, it means poor packaging. The rest is between him and UPS.

If your initial intention was to get a general consensus on how people believed the matter should have been handled, I don't see the purpose of calling me out. Sounds to me like you wanted to publicly shame me on what you felt was poor packaging. When in fact, you didn't know that to be true because you never received the package yourself. You are giving people only half of the perspective and are only going off of the information kustom54 gave you. The biggest problem I will face with this is situation is proving it was damaged during shipping, because there is no concrete proof. Sure if the buyer received the box and it was damaged they could have refused it or took photos of the package but he did not. He had the package sent to a 3rd party. Now the validity of this entire post rides on a product the buyer has never seen himself and is going off the word of the 3rd party. If we're throwing perspectives out there how am I %100 Sure the 3rd party didn't accidently damage the product and is using me as the scape goat? It is my full intention to resolve the matter as timely as possible and I would have hoped the OP would have given me adequate time to do so. To be clear I did send OP photos of the package prior to shipping that he okayed. Never was using bubble wrap mentioned to me. I told specifically I would wrap in towels and packing material. It is unfair for the seller request a refund when I have not received my product back. If you buy a product at a store, you cannot bring a photo of a damaged product and expect a refund without physically returning the product first.

Ups will NOT pay! I have done this before and it’s an extremely long process and they absolutely will not pay with packaging like that. They would have to be bubble wrapped with foam for them to claim responsibility. Also if the box doesn’t have a seal stamp they won’t pay either

This is a spot on assessment. This "dispute" is not worth a thread. The buyer is covered, the seller is not. The seller will not be made whole in this transaction, so why run name through the mud? The public airing of this grievance is premature at best.

Same shit happened to me a couple years ago.

Sold a set of headlights, shipped to a ‘respected’ retro fitter and after a month he decides to open the box, a month passed so no claim could be filed.

I ate the cost, lesson learned though.

Always file a damage claim on your end regardless of who shipped the items with the shipping co.

In your case that would difficult since the shipper sent your items to the retrofiter, and not you.

I only read your ok, but you could have still requested a damage calltag to pu from the retrofitted.

IDK if it's fair, always insit the products were damaged during shipping. Shipping co. Is liable.

can proof of said conversation about bubble wrapping the headlights be proven/disproven? or conversation about buyer agreeing shipping conditions were fine?

'tis what I see as the fine line here.

Man that sucks.. for all parties involved.
I've filed some claims, and they are hit/miss as far as payout. They make the final call based on packing pictures, and I'm just not sure if this is going to fly.

If it were me... I'd Have 54 send lights back to me so I have something in hand. Then Refund buyer while I wait for the claim.(they are going to have to get reimbursed regardless of outcome right?). If claim goes through, sweet. If not, bummer and chalk it up to learning and move on.
But... I'd fix the tabs(superglue and baking soda trick works really well in this case, I've had to do it before!) and either mod the shit out of them or sell them as "broken tabs" to try and recoup some $.
Just my .02 good luck with the resolution guys.

No bubble wrap was used, only kraft paper.

I see that, but OP said bubble wrap was discussed and emphasized, and seller says they were never told bubble wrap and OP approved the shipping method.

one or the other needs to be confirmed with evidence.

I bought new lamps from a dealer, sealed in a Toyota Lexus genuine parts box. Not sure which is the current box, that style or the box with the red ink on it.

The bezel had the tiniest nick where the ridges are to diffuse the sideways light output, and the sealant was a bit funky.

Like I said the box was sealed, and the lights look and feel new.

    Just throwing that out there.
