No reason to bring a lawyer into this situation yet.

You titled this thread "What to do?" You've been advised to take it to another dealer, under warranty, and have it fixed. Why the reluctance to that EXCELLENT advice?

But brakes, rotors or drums wouldnt cause the vibration when not braking correct? I do have a shutter when braking but there is also a vibration when moving at at any speed without applying brakes and worse at highway speeds.

Reluctance? how so. I plan to do what people have suggested. First I am going to see if the dealer I got it from resolves the issue. and if not then I will take to another dealer and see if they can find the problem. When did I say that I am not going to follow the advice that was given?

Warped rotors can cause a vibration all the time, not just when braking. The brake pad is held within a few mm of the rotor. If the rotor is warped, it will contact even if you are not braking. That's why driving a few miles might heat up your rim/tire if it's warped badly enough. I don't know anything about drums, so I don't know how well this would translate to the rears.

Just took it for a drive and rolled down the windows the rear drums is making noise when braking. Hopefully is just warped rotors and drums. I see on a recent service record says owner complained about braking and rear brake noise and they turned the drums.

Thank you to everybody who replied and helped me out, I will update this post once I talk to the dealership or take it to another to diagnose. This forum is dope, I've never had so many replies on other car forums for past vehicles. Hopefully I'll stay a part of the Tacoma family.

Lemon laws only apply to new vehicles.....used you better do your research first. Least he has the benefit of a factory warranty. I would probably head to a different dealership with a more competent service department.

Interested to find out as well. My guess (since you did tires already) is warped rotors and something with the drums (not properly adjusted maybe?). There's also the possibility of a wheel bearing too. Any number of things could have caused said issues even on a newer vehicle.

This. That heat is going to be a huge clue to narrow it down. You could have a intermittently sticking caliper or hose not releasing the pressure all the way..

I think the problem is that if we bought a used truck from a dealer that knew about the problem we would not give them a chance first . We would go to a different dealer right away and see what they find . From the information you are giving us we have no faith in the selling dealer .

You said that in some kind of paperwork there are notes that say they couldn't fix something.. If they end up telling him he is SOL, isn't that enough right there to make a case against the dealership regardless of it being used or any kind of warranty being expired? Do we still live in a time where dealerships can be this scummy?

It was sold to the original owner and serviced/ traded in at the same dealership I bought it from. When reading the service records on toyota owner, it is showing that he took the vehicle in 6 different times for "drivability issues/ vibration when braking. The last time being 10/20. Its says could not replicate on the report. And one instance the rear brake drums were turned. Its just weird that i notice these issues, and then i check the service reports and see that the PO was complaining of the same problems. The last service was at 19k miles for the drivability concerns. and it looks like he traded it in not to long after that, cause i bought it with 20k miles. The report doesn't say they couldnt fix the problem, i just assume they didnt because he kept going back with the same complaint according to the reports, and him trying it in shortly after, and then me buying it and just so happen to experience the same problems. Also it has had the vacuum pump replaced twice, valve cover leak, and lifters and rocker arms replaced. But I thought these engines didn't have lifters. Kinda bummed, but all i can do is see what they say they are going to do, cause I feel like I shouldn't be spending a dime out of my pocket and going to a different dealership to find the problem when I just paid 30k for a vehicle.

    What state?
Were the service records present on the vehicle, in the "Buyer's Guide" at time of purchase?

Bought it in Georgia, they gave me the printout of the carfax, it showed the service records but didnt have the reports or why it was serviced. But after having problems I went to Toyota website and went to owner registration and it had all the service reports with notes. I didnt see a buyers guide? The saleman just made the comment that it had been serviced alot that the owner took care of it. I just seen the service records, clean carfax, 1 owner, and thought It was good to go.

The vehicle did not have a "Buyer's Guide" and you didn't receive one after purchase?
I'd contact your state's attorney general and find out what disclosures are required for an "as is" sale.

OP, I feel your pain. I really hope this works out best for you.

You are getting some good advice here -- and I know you are listening to it. I can only offer what I would do if I found myself in your shoes. Call me crazy (many do) but I am a proceed on multiple fronts kind of guy. I would be looking to explore all of my options and pick the option that moves forward the fastest (since you just want this nightmare over and get on with your truck) and is in your best interest.

First, I could go back to the dealer and immediately inform them you want to return the vehicle. I would have a letter in hand stating such. You need to look at the return clause on the transaction ... depending on the agreement you might have a no hassle return policy in X number of days. I don't know if you had the service records before or after the transaction and that may matter. But I would go to the salesperson and the sales manager saying you want to return the truck ... now what do we do?

Second, I would also take the truck and the service records to another dealer. Ask them to review. Ask them to also do a full CPO kind of inspection. Have them check everything and get a second opinion. In your case, I would ask for a Toyota Master Mechanic -- sorry, can't remember what the official name is but I would ask for that. I might even get a third opinion.

Third, I would call Toyota and open up a case. Tell them what is going on and tell them you would like their involvement. That doesn't mean that you are being a jerk but the car is under their warranty and their dealer is unable to resolve the situation. You want them to be aware in case you need their involvement down the road. You want a paper trail. In the warranty booklet that comes with the truck, Toyota does make available a dispute resolution / arbitration process. I wouldn't go there yet but I would collect notes and documents so that if I had to, I would be ready.

Good luck ... and please report back. No need to go nuclear just yet ... but kickstart those three processes, document everything and be polite and professional but firm.

I agree with the above. While some good advice has been given, specifically on legal recourse, you should save this as a last ditch effort. The dealer will most likely tell you to pound sand if you threaten them.
