Bust out the Bat to show him you are serious. Man since he isn't paying File a police report and sue him. Or take the Porcelain from a spark and throw it at his window. Its very quiet and effective.

All this "kick his ass" talk is from young insecure males that don't know any better.

You're on the right track - take him to court, get your money back, and make sure he/his family has to cover your lawyer's fees, pay for a rental while your truck is being fixed, and be sure to go for a little extra for your time and inconvenience. You may not get the extra, but you might as well look to rape the guys wallet while you're in there.

That's true. You have a lot of self-control. Good luck in small claims. You should win since he admits to hitting it and you have witnesses. Don't give up man, make him responsible or other wise he'll continue to think that it's ok to destroy others property out of anger and not have any consequences for his actions.

Good decision. An alternative decision may be you and your father could even talk to his father before you go through the legal system. If that doesn't work then you may have luck presenting him some lawyer written legal papers.

From what I know his dad is insane and beats him. I'd rather just sue. We're both of age and maybe his dad won't even know this all went down.

any witnesses to this? They may say "your word against his" and not do anything in court. You need some form of proof.. yes?

EDIT: I see you had witnesses! Good! You're set then dood. Good luck actually getting money out of him. :)

Man, I'd get the witnesses to make statements NOW before you go to court. It's amazing how many folks won't go to court to back someone up, mainly b/c it's such a PITA and time waster, and oh yeah, they're in high school and can't miss class.

Get it written (lawyer or PD should know how to do this) and they can probably be submitted in lieu of having to actually show up.

Oh, and really watch what you post on forums (including here) about this. Don't want to slander him and get counter sued.
