    Judy is a stubborn old hag that goes off half-cocked with little regard for the law so I don't watch it. People's court and the one with the tall guy that used to be a cop are realistic. I met that guy at a biker hangout once, really cool dude. All the other court shows are all about drama bullshit and again, with little regard for the law.
    I think what happened here is that the kids were from different families, one took the deal and the other didn't. The parents that took the deal sued the parents that didn't for half the damage, but the ruling makes sense because one family got all the benefit of no felony for their $7000 payment.
    Not taking the deal and letting the kids have a felony-some would say that's a bad parent, I say a good dose of tough medicine. Buying the kid's freedom sets an example that may lead to more nonsense in the future.

    I kinda did that once. A kid stole a radio amplifier I had on a bench in my front yard. Coincidentally on Halloween and after I'd given the punk ass mutherfucker some good candy. I gave chase with a small piece of 2x4 in my hand. I quickly realized I wouldn't catch him so I took aim and fired. I'm a shitty thrower, but surprisingly whammo! right on the back of the head. 20min. later there's the kid, his parents, the three other kids with their parents, and a cop in my driveway. The cop: this kid says you hit him with a 2x4, did you? YUP, here it is. The cop was shocked as hell I'd admit it. I immediately followed with the story of the theft and told him if they have issue with my hitting him I'm pressing charges on him for the theft. Now this was 20+ years ago and I think there was still a little more logical judgement used and this cop struck me as 'old school'; I wouldn't have admitted to it today. The cop had some words with the kids and parents ending with "if any of you ever come back here for any reason you will be arrested" and sent them walking. He told me what I did was illegal and even if I could prove the kid stole, it was not justified....but good job, I get it. When they don't learn at home someone has to educate them.
    The only time you can legally use any force is in defense. Throwing rocks back would only be justifiable if you did it to stop them from continuing to throw rocks at you or possibly other innocent victims, so that's what you have to tell the cops if they show up. If one accidentally gets hit in the back, he turned after you released the rock.

    To a certain degree, it is also true in California. Not by the letter of the law, but rather as an effect.

    No, you can't run out your back door and shoot someone climbing over your fence, but we have no duty to retreat FROM our homes.
    If there are signs of forcible entry, that is an affirmative defense that we felt that our life was in danger.

    So the law states that you must be in fear for your life, but signs of forced entry legally provide that assumption (just don't shoot them in the back as they are leaving)

    Understood - I was addressing the point of using force to prevent property loss with a fleeing suspect. You are allowed to use force in Texas in this situation. Obviously I quoted the deadly force statute but lesser means are acceptable. I'm not going to shoot someone over stealing an amplifier but I'm warming up to the idea of throwing a 2x4 at them...

    § 9.42. DEADLY FORCE TO PROTECT PROPERTY. A person is justified in using deadly force against another to protect land or tangible, movable property:

    (1) if he would be justified in using force against the other under Section 9.41; and

    (2) when and to the degree he reasonably believes the deadly force is immediately necessary:

    (A) to prevent the other's imminent commission of arson, burglary, robbery, aggravated robbery, theft during the nighttime, or criminal mischief during the nighttime; or

    (B) to prevent the other who is fleeing immediately after committing burglary, robbery, aggravated robbery, or theft during the nighttime from escaping with the property;

    I have had kids throw snow balls my me before. usually you can turn around or stop real fast and get out and they take of running like little girls. but rocks are a lot worse than snow balls!! probably 8 to 10 years ago now some kids threw a brick of a bridge and it int threw someones window and kill the lady and they went to jail!

    Not my proudest moment, but it turned out ok.
    I was 12ish and at a "bad influence" friends house along a state road. We were making tons of snow balls but couldn't find much to throw them at. It started getting dark and we found that we could time the cars passing a hedgerow that ran perpendicular to the road using their headlights, even though we couldn't see the cars coming around the house. We dialed in our timing on the first few cars with some good hits, tire screech and all. Lined up for the next shot, let it go, and it was a cop car with the window down...
    Went right in the window...
    He spun around and figured out where we were real quick! We ran like hell and hid, he went to a couple doors until l he found my friends mom. She beat me like I was her own kid. Then when my mom picked me up, she told her all about it and I got beat again. He got his too.
    I do find myself glad that nothing worse happened, now that I understand the risk!
