    if its his fault, you get to take your truck to any shop you want for repairs/estimates. So, what you do is take it to the most expensive place, get the estimate, and just take the $$ from the insurance company and do what ever you want with it. Plain and simple....and awesome!

    When I went through this the other guys insurance adjuster (USAA) came and looked at my truck. Made the Assessment, and then cut me a check for what his estimate was for damages.

    The body shop I went to made a slightly higher estimate. I called USAA and they said the shop could invoice the difference, but the cash I had in had is what I would get upfront; they would spend more, but through invoice only.

    I pocketed the cash I got and had the body work done cheap.

    That's normally what they do around here as well on a repair claim. They might increase the payment above their adjustor's estimate, but only if a shop files it with proof of the extra costs.

    Similar thing with homeowners roof repairs after storm damage on an old aging roof. They will give a you smaller check for say half the cost of a new roof, then promise you another payment for up to X amount after they inspect the work and invoice. So then it is up to you to find someone that will do it for that amount (or close)

    This isn't exactly how it works out. You can bring it to any shop you want to have it repaired at YES. They can give you a very high estimate. However, his insurance company will still have their own adjuster come out to do an estimate. Without proof that you are actually getting the work done for X amount at said body shop, his insurance company will do whatever they can not to pay you more than they think is fair.

    As someone mentioned, they'll cut you a check based on their estimate to at least get the work started. Excess amounts will need to be billed to the insurance company of the party at fault.

    I forgot to mention. Specify all OEM parts for the repair. The argument here is to protect the car from depreciation due to the accident.

    I was just rear ended- not my fault as well. Here's what I did that payed for a custom rear bumper, lift, tint, speakers, gas...living $...etc

    Tell your insurance you are NOT sure where you will get it fixed, and that you're shopping around for where you'd like to get the repairs done. They will send an Insurance Adjuster your way when they can, he will document everything in his computer program at your house. He will cut YOU a check to do with it whatever you want.

    Go get everything looked at, if it's just superficial and no problems- let the shop know you'll do the work yourself (if you want to save $)

    Have them also run an estimate for how much they would charge- if it's more than your insurance gave you- they will cut the check to the shop. This doesn't really do you any good if you'll get aftermarket bumper and sh*t like that.

    Make sure you don't tell them where you are getting the work done- because they will cut half the check to you, and half to the shop!

    Why are YOU waiting for HIM to file a claim? He was at fault. You call his insurance and file a claim. If they fuck around, you call your insurance and get them to go after him and his insurance.

    I second that, I filed my own claim immediately- once their claim was up and running (we both have the same insurance) it took over mine, because they were liable. Get on it asap, just my .02
