    If we have this smoke law for the kids, or they say kids, why don't we have laws for kids that parents cannot be around their kids if they have been drinking? More kids are hurt by parents that drink and then go home and abused other family members, kids included far worst then smoking around them. But no one cares about that.

    No people should not smoke around kids. We pick about a tiny part and turn ours heads to the real danger. I don't care about the law one way or the other, as it would not affect me at all.

    I will pose the same thing again to you: If you make a statement claiming that more kids are hurt by drunk parents than by smoking, how about show some stats please. I can make the claim that more people fall down by tripping over themselves than by kids leaving toys on the floor, but that doesn't mean it is true. Trying to work with facts here with everyone, not just assumptions.

    Actually, in this instance it doesn't matter.

    Regulating drunk parents is a straw-man argument. It's replacing the act of drinking - which in itself is benign, for the more serious act of abuse - which is already illegal.

    A better correlation would be to compare smoking in a car with kids to beating them with a belt. Both are recognized as medically harmful.

    Kids aren't forced to eat salt every time someone in a vehicle has an open bag of Doritos. However, when someone in a vehicle is smoking even with the windows open, people in the vehicle are forced to breathe in the smoke. There is a bit of a difference here. :cool:

    Look, smoking around kids isn't healthy and they usually don't have a choice in the matter regarding their proximity to it because they're doing what their parents tell them to do. Put into law or not, it's not healthy for the kids and is a horrible choice made by an adult.

    Sadly, most people recognize this. However things that should be common sense get passed in to law because:

    1.) People are too lazy/lack the resources to do it themselves. This is the basic reasons law enforcement exists.

    2.) Those who are willing to police their less-than-intelligent neighbors need some legal standing to do so, lest litigation for things like harassment ensue.

    I never said to charge a person with a crime because of what they MIGHT do. They are smoking in a car, a confined space, with children. It has been proven by the CDC that second hand smoke is harmful and damaging to children's lungs. So we are not charging them with a crime because of what they MIGHT do, but by what they ARE doing, and that is causing harm to a child. You are comparing apples to oranges with that argument.

    I have plenty of common sense as well Sure, you don't HAVE to prove anything to me. However your comment of the effect of a drinking parent over a smoking parent in a CAR, which is what the subject here is about, holds absolutely no water. And by the way, the phrase would be: "Maybe you would like to tell me there are more smokers than drinkers." (as a sentence, not a question, hence the period at the end. And I have no intention at all, nor have I ever claimed that there are more smokers than drinkers, or the other way around. The subject of the thread was about laws concerning smoking in a car with children. Good day to you.

    That's an aggravated DUI though, where smoking with a kid in the car is still legal. F'd up world we live in.

    Here in AZ it's illegal to not have a child restrained in your car/truck, but it's LEGAL to have them unrestrained in the open bed of a pickup truck.

    From my experience and through observation, I have come to the conclusion that many smokers have little or no consideration for anyone but themselves when it comes to them indulging in their habit. They don't seem to care who their smoke affects or how it affects them. They don't care about all the cigarette butts thrown out the window at traffic lights that look trashy on the medians. So why would they care about someone breathing a little harmless smoke?

    Smokers also have a strong sense of entitlement and feel that they should have the right to smoke wherever they want. I agree with this as long as they do not affect the rights of others to breathe smoke-free air.

    Do whatever you want to yourselves so long as it does not affect others. :cool:
