Yup there's no reason why you should have to give them YOUR truck. If you don't listen to them and drive while parts come in and something happens it will most likely fall on you. Tell them you use the truck for work and need to have all the amenities your truck offers.

Tighten the bolts carefully, get a quart of spec fluid, top off the fluid and keep an eye on the fluid level until a proper fix is available. Then take it in when they don't have to hold it for weeks. If you've already taken it in and they won't give it back, inform them that you will be using the loaner/rental (that they WILL give you) as if it were your own truck because you need to earn a living just like everyone. You don't have a choice and neither would they, in your position. I'm pretty sure they would not totally screw a customer in that way.

Yea but it seems some people think there is no responsibility on our part if we are given a rental or loaner?? If I dump something heavy in the bed and it damages it, it's not like I have a free pass. And I HATE the idea of my truck collecting dust and baking in the sun on a dealer lot. Anyway legally they can not impound my truck unless the laws are different than I understand them. I am still waiting to hear back on my waiver request.

Do NOT sign a damned thing--they have no legal authority to confiscate your property, if they insist call the police. The Toyota letter to dealers tells them they are supposed to hold new and used vehicles they have in stock (i.e. not sell them) --not seize customer vehicles--but they are too stupid to understand that...

now that they have my truck i am forced to hold off on some mods.
i might consider letting them keep it as partial trade for a 2018.
    i still have a t4r as backup.

My truck got recalled as well. Check out the lemon law in your state. If they can't fix it within the time limit Toyota should be required to give you a new truck.

you have nothing to worry about, the OR and MT are not being recalled, you have both. If they find a leak in your diff you can still take it home and schedule the service at your convince since its not a safety issue on your model, if it was it would have been included in the recall.

Has anyone with a MT or OR had their truck seized by the dealer? Mine looks to have some very minor leaking, nothing I would even worry about, but if they see that I do not want them to give me grief at my 15k service...

Just got confirmation from my service advisor that I can take the truck after signing a waiver acknowledging the problem and risk. Fine with me. Until they offer their official fix I will keep and eye on the diff and add fluid if need be but the leak has to be small since I have seen nothing on the ground as of yet. Maybe I will make sure the bolts are at 18 foot pounds torque too.

I brought my 17 sr5 2wd with build month of march in for the recall after I only had the truck for a couple weeks and about 1500 miles. There were no leaks present on the diff and dealer torqued the fasteners and I was on my way. My truck was most likely either too new or not enough miles to develop a leak. I hope it was not just a band aid fix to just get us beyond the power train warranty if it the diff gasket is indeed faulty or poorly designed. I guess time will tell. Hopefully they get the parts in soon for the ones that are leaking. Best of luck Duf, your YouTube channel gave me a lot of tips and things to look out for with the 3rd gen Tacoma.

No way I'd let my truck sit on the dealer's storage lot, exposed to the elements & would-be thieves, paying loan payments on it, all that for an unknown amount of time.

I wouldn't have signed a damn thing and demanded my vehicle back.

I don't mind signing a waiver to get it back. I am surprised just how many people were ok with handing their truck over to the dealer based on the big thread linked earlier.

You have an OR, its not listed in the recall so they have no right to keep your truck. If it is found to be leaking then warranty work would be performed.

Tale the rental truck from them letting them know it'll be used for work (since that's what you use yours for) and make them cover your payments while your truck sits with them :D

They can't. They may persist they perform a service to fix it which is great, but according to Toyota there is no threat to vehicle safety on the larger axle so they cant twist your arm into letting them keep it or make you sign a release ect, if there was a safety concern it would have been included in the recall. So just scheudle the repair at your convince, if they say it is a danger to drive call Toyota corporate and file a report with the NHTSA or the proper governing body and inform them that Toyota is saying there is an issue with your vehicle that is dangerous and they have not recalled yet.

    So riddle me this ?
Why in the world didn't all manufacturers impound every car that had a defective Takata air bag with possible lethal shrapnel ready to deploy until the part was available ?
I'd take a sweating diff over a shrapnel air bag any day.
