    Brother pray you get your truck back soon otherwise when you drive on your Focus and see a Taco Beast pass you by you will probably feel a bit grumpy !!!! it will pass though, I hope, after 25 days without my truck needless to say I have some serious emotional issues ........

    FYI to anyone who reads this do NOT destroy your credit by refusing to make payments that is terrible advice.

    You're free to call the police but don't be surprised when they laugh at you and tell you this is a civil matter take it to court.

    First of all DO NOT stop making payments, that's TERRIBLE advice and will only destroy your credit.

    Feel free to call the police but don't be surprised when they laugh at you and say "this is a civil matter take it to court"

    The proper way to handle this: be cordial but firm on getting a free loaner truck, then beat the shit out of it and rack up as many free miles as you can until you get yours back.

    I fucking WISH my Tacoma was part of this recall I'd love to get thousands of free miles on someone else's truck and save the wear and tear on mine (I drive a lot). If they offer you a random ford focus rental car don't lose your cool, again just be cordial and firm and dollars to doughnuts you'll eventually get a truck.

    A friend of mine made out like a bandit on a 2012 Corolla she purchased private party earlier this year, it was part of the takata recall and Toyota put her in a brand new Camry rental car she's had for like 6 months now, she didn't call the cops or bitch about refusing to sign anything... she took the free car and is stoked she's put over 10k miles on it.

    The purview of an unsafe vehicle on the road is left to the CHP/state police. Your local sheriff's will not be making any judgment on that. The dealer can absolutely alert the appropriate LE that you have taken an unsafe vehicle on the roads, it will usually result in a suspension of the car registration with the DMV, if not the LE contacting you themselves.

    Also like the other person said, it's a stupid idea to stop making payments. The financer , whether it's through Toyota or anyone else, is not going to give a fuck about anything other than if they get a check on time each month. You will ruin your credit if you do that.

    I don't think a manufacturer initiated recall prior to official notification carries the legal weight you think it does.

    So after being on the phone for two day saying my rental car needs to be a truck they said that can't accommodate me. So I can go get my truck back in till the recall can be fixed. They said they tighten everything down to spec and check the fluid level. So looks like I'm getting my truck back tomorrow. Not happy. But happy it's not just sitting on there lot

    Outside point of view, it seems crazy to me, that Toyota would ask for the affected vehicles to be keept at the dealership without having something to do to them.

    ok here we go again, sorry I need your input, Tacoma has kept my truck for over 30 days now and the last thing I heard from them, two days ago, was that they don't know when this recall problem with oil leakage will be resolved. Toyota gave me a loaner the first day they took my truck away. HOWEVER, do I have legal grounds to request that my truck be replaced for a new one......Lemon Law maybe ?, my truck was purchased on April 2016 and has 12090 miles....also what happens to the warranty during the days my truck remains at the shop, what about depreciation issue while your truck is parked at the shop, Another concern I have I already made a few mods to my truck to include installing new 32 inch tires and 20 inch rims on my truck with a 2.5 lift , seeking honest advice, input and feedback appreciated....I just want to see how other people view this situation. I already have an opinion on this matter, but I want to brainstorm a little......thanks you guys have been very insightful in the past that's why I'm restring this thread....

    In mi opinion if the dealer seized my vehicle without providing me with the option of keeping it, then I think they should respond for keeping my vehicle over 30 days in out of service, I think that the day I surrendered my vehicle to the dealer is irreveleant because I was ordered to do so, therefore I hold them directly accountable ,

    You need to look in to the lemon law for you state. Contact the lemon law lawyers. See what they say. The dealer took my truck also and gave me a rental. After two days with a rental I told them I needed s truck not a car. They told me I could have my truck back. They said they tightened the nuts on the the rear diff and check the fluid level. I picked it up the next day. They said they will contact me when toyota issues the fix. It's funny to me that they hold my truck from me because it's unsafe but when they can't accommodate me on the rental they give me my truck back. Wth

    Wow that is wrong in so many ways, I already filed a complaint with the local Consuner Affairs office and plan to pursue legal action !

    They do provide you with an option if you want to keep your truck. Sign a waiver stating that you will be responsible if any problems occur due to the recall notice.

    thanks I was not provided with the waiver option thanks for letting me know. When I asked to get my vehicle back their response was they could not.

    I don't know what the interaction between you and your dealer is. Perhaps in person you are not as vocal as you are on this forum. 30 days is a long time but not out of the ordinary from what I am reading on TW.

    It is your choice on how you want to proceed. Keep in mind Toyota is making an effort to find a permanent solution and in most cases have provided rental vehicles.

    This ordeal you are going through would not make me happy either. It sucks you are paying for a vehicle you cannot drive. If your case does meet the Lemon Law definition, it is in your right to initiate the process (check with your state). In most states, providing a loaner would not meet the definition of Lemon Law.

    In summary, I feel for you. I hope Toyota makes it right. Perhaps negotiate an extra month or warranty beyond what you already have.

    I did. I brought it in last week, they said my VIN is not listed on the recall, but they are treating it as such. Toyota has not released any procedures at this time, and they have been told to re torque the diff bolts and wipe the housing clean . So far, bone dry. Service adviser did state that if it were dripping , they would have replaced the gasket . But , it wasn't. Dealership said to keep an eye on it , and if it keeps seeping to bring it back in. They offered to keep the truck until the recall was issued / remedy was released, but I said no .

    I'm not leaving my truck parked at a car lot as long as I have a note .
